Family Class Sponsorship: Who can Sponsor The Family Class Sponsorship Program allows families to be reunited by allowing adult permanent residents and citizens to sponsor a family member for admission to Canada. To be considered eligible for sponsorship, the applicant for sponsorship must be:

Spouse, common-law, or conjugal partner ● Dependent child ● Parent ● Grandparent ● Sibling or niece, nephew or grandchild younger than 18 years old who is not married and whose parents have died The sponsored person must live outside of Canada to be eligible for sponsorship unless they legally reside in Canada for a short period, as through a study or work permit through student work permit Canada.

  4. What is a Spouse/Partner? The following categories of people can be sponsored: Spouse Legally valid marriage in the country of origin according to Canadian law. Common-law partner: 1 year of continuous cohabitation in a relationship with a spouse. Conjugal Partner Conjugal relationship of at minimum twelve months (permanence and commitment that is similar to common law or marriage) when a couple is barred from living in a joint home due to immigration restrictions or religious beliefs, sexual orientation, marital status (e.g., the couple is married to someone else when divorce is not permitted in the country of origin) The same-sex relationship is considered to be legitimate for purposes of immigration under these categories.

  5. What is a Dependent Child? If the child is sponsored by the parent or by the spouse of the sponsor or common-law partner, it could be considered dependent if they are less than 22 and have no family member or spouse. In addition, children over the age of 22 may be considered dependent if they depend on their parents for financial assistance before age 22 and cannot sustain themselves financially due to a physical or mental illness or condition. Children with sole custody of a former spouse are still considered dependent kids and must be reported on the sponsorship application. In addition, if the dependent child sponsored has dependent children that they own, the sponsor has to prove their financial ability by proving that they can meet a minimum income threshold.

  6. Who can Sponsor? Sponsors must have a Permanent Canadian resident of Canada or a citizen who is over 18. In addition, the sponsor must be a resident of Canada or be an American citizen living abroad and intending to move to Canada after the individual who sponsored them is accepted. A person is not able to sponsor someone if: Are you in prison? Are the subject of a removal order Get social assistance from Government (except for those with disabilities) Are convicted of (or attempted or threatened of committing) an offense that is sexual or violent or has resulted in the bodily injury of family members. Aren’t able to pay child support Aren’t able to repay the loan, failed to pay on time, or missed payments If you have sponsored someone in your family in the past but did not meet the requirements You have sponsored a former spouse or partner that has not had a legal residence for longer than 3 years. They were sponsored and became permanent residents less than five years ago.

  7. Sponsorship Agreement In addition, the sponsor must also accept financial support for relatives if they cannot pay enough for their own needs.
