  1. California’s Gun Control Laws and Legislation Gun control laws of California are very strict, limiting and preventive. The protocols to acquire a license for a firearm are tedious, detailed and pretty hard. There are many convoluted and twisted laws that gravely reduce the purchasing power of the general public. In order to get hold of California legal rifles, a person has to go down a funnel of restrictions like the rifles may not be shorter than 16 inches and the buyer must have a safety certificate on him/her at all times. The restrictions are not only limited to purchases or ownership of the firearms and weapons, it further extends to the capacity of magazines and even how much ammunition one can possess. Furthermore, there are a list of detailed laws that one must thoroughly go through in order to steer clear of any legal trouble. Even if the applicant of the firearm has a genuine need and has also gone through a thorough background check, California is still a “may-issue” state. The license is issued by the county sheriff or local police station officers. Other law enforcement agencies can also issue licenses or also have the right to revoke one. If a person is moving in the state of California, already owning a firearm must report to the Department of Justice (DOJ) and notify them about their firearm possession. The DOJ will run a thorough background check on the person, enter the information in their database. Same is the case when the person wants to sell or transfer the firearms to someone. But all this is just the tip of the iceberg, California gun control laws and legislation has a lot more to it. In this article, I will try to simplify the most commonly asked questions so that you can get a good idea about the laws. 1.People who are Eligible and Non-Eligible to Buy a Firearm People above the age of 21 are eligible to buy, own, possess and transfer a gun. But it also prohibits some people from obtaining one. The people who fall in this category are convicted felons, mentally unstable, drug addicts, who have restraining orders against them especially in a domestic violence case and all the people who are under the age of 18. All the eligible people must have a valid Firearm Safety Certificate with them at all times when carrying the gun. 2.Legal Process of Buying, Selling and Registering for a Firearm in California There are certain protocols that everyone who’s eligible to possess a gun has to follow. Firstly, let's look at the rules and regulations for buying a gun. All the firearms are to be purchased under the California’s Dealer’s Record of Sale (DROS). No matter if the gun was purchased in a private party exchange, gun shows, instore or online. The interested purchasing party has to provide a proof of age, a proof of California residency so that the DROS can process the license. Next comes rules for selling a firearm, which are also quite detailed and comprehensive. If you want to become a licensed seller of firearms, you need to fulfil certain

  2. requirements under the Penal code 26700 PC. These requirements are having a license under the federal law, having a business license and also a seller’s permit which is issued by the State Board of Equalization. These licensed sellers then further do background checks for the purchasing parties that come to them for buying and selling of firearms. Lastly, the registration of the acquired firearm requires a Firearm Ownership Report Application. This is especially essential if you’re moving into the state of California. 3.Concealed and Open Carry of the Guns According to the Penal Code 25400 PC in California, it’s a crime to carry a loaded concealed gun. But if the person is carrying the California Concealed Carry Weapons License CCW then that person is legally authorized for it but it's very hard to obtain the CCW license. It is also a punishable crime in California to openly carry a firearm no matter its loaded or unloaded. But this law has one exception, a county sheriff can issue a license of an open, loaded firearm in public if the population of the county is under 200k. carrying an unloaded gun openly is considered an offense which can result in jail time of one year or a fine of maximum $1000. 4.Completely Prohibited Firearms in California There are some firearms that are completely prohibited in the state of California. No one can manufacture, buy, sell, gift, lend or possess them, under any license. These firearms include, short barrelled shotguns, undetectable weapons, unconventional guns or any weapon such that can be camouflaged. But the good news is that California legal riflesdon’t fall in this category and can be bought and sold by interested parties. Conclusion This is a short overlook at the gun control laws of the state of California. If you want to buy or sell a gun, the county sheriff or licensed personnel can give you an even deeper look into the wholeprocess and can answer your specific questions with more details.
