  1. John Grasso Explains What State Defines As Sex Crimes As in every other state across the nation, sex crimes are a matter of as much a concern in Rhode Island. When it comes to this kind of crime it is important to take note that states have different stipulations as to what constitutes what kind of sex crime. The team of leading experts of sex crime lawyers at John Grasso opted to expand on what counts as a sex crime and what would the consequences be of a guilty verdict of such a crime. The legislation divides sexual assault into three categories. These are first, second and third-degree sexual assault. For a guilty verdict on a charge of first-degree sexual assault, the prosecution has the responsibility to prove that penetration took place beyond any doubt and that the victim was either mentally disabled, helpless or incapacitated. It can also be that coercion played a role, or that the accused used force, concealment or even surprise to force the victim into the act. The penalty upon guilty sentencing is no less than 10 years for such a crime. A second-degree sexual assault would indicate that there was sexual conduct but the prosecution can’t prove that actual penetration took place. What they can prove though is that the victim was in no mental state to agree to sexual interaction as the person was mentally incapacitated or physically helpless. The penalty for such an offense is no less than 10 years in prison but also no longer than 15 years. Third-degree sexual assault would be the charge when the accused was older than 18 years at the time when the crime took place while the victim was either 14 or 15 years old. The prison time for such a crime is no more than five years. However, these aren’t the only kind of sexual offenses as child molestation also falls into this category. First-degree child molestation requires that sexual penetration took place and that the victim was younger than 14 years old. The legal system requires a harsh punishment upon a guilty sentence and requires a prison sentence of no less than 25 years, but it can also be as much as a life sentence. Second-degree child molestation would also only be applicable when the victim was 14 years or younger and while there is no need to prove penetration, the prosecution would need to prove that sexual misconduct took place. The sentencing for such a crime is no less than six years and won’t be more than 30 years. Another sexual crime that revolves around the victim being a minor is an indecent solicitation of a child. During such a case, the prosecution aims to prove that the accused was 18 years or older and the victim was younger than 18 years. It is also necessary to prove that the accused was aware of the age of the victim. Solicitation entails that the accused commanded, authorized, instructed, requested or incited the victim to act in a manner that might include written or visual

While these crimes are all severe, it is becoming a wider concern that Americans are facing a false accusation of sexual crimes. Merely the accusation of such a crime can be devastating to anyone’s life. It is the kind of charge that can rob someone of their career, their financial status, having access to their family and it simply ruins a life.
