  1. What is a Motion to Dismiss and How can You file One? There are many instances when a person might feel that the claims that are put against him in a court of law are not legally valid. For an instance, if you are involved in an incident and not much damage has been engaged by both parties, yet the person files a case against you. In that case, either a person can travel to the court at certain times to prove that he is not guilty. That will cause too much time and effort. Moreover, a loss of money also takes place. Or, a better option will be to file a motion to dismiss. In this scenario, a person who believes that all the complaints that have been put up against him are legally invalid. There are various circumstances when you can file this. Read this article further to get to know about some of them.

  2. When can you file a motion to dismiss? If the defendant's complaint fails to adequately disclose all of the components of a claim or fails to acknowledge a measurable injury, the court may grant the motion. In another scenario, if the complaints are not served properly, a person is liable to file one. The venue also plays a key role. If the venue is not proper, a person is eligible to opt for the dismissal motion. How can A person file one? The motion must be submitted to the court and addressed to the opposing party. After that, the opposite side has a couple of weeks to react to the motion. After reviewing each side's motion, the judge will render the court's verdict at a set hearing date. Before filing one, it is advised to speak to a renowned attorney so that he might be able to assist you with all the proceedings and details that are required. There can be grounds when your motion is rejected. Two different parties involved always go to the court over different ideologies in a case. However, if some facts are true to the cause and there is no need to have a dispute over them, a motion for summary judgement can be filed. Talking about the above example, if a person feels like he has not done anything wrong yet is being dragged unnecessarily into the court of law, he is liable to apply for this. For those who are not related to the law world, this can help them save their time and energy.
