They may even become public and negatively affect your reputation, in some cases. Their outcome cannot be guaranteed, and this often makes them emotionally draining and stressful. Because of this, discerning individuals and businesses try not to go to court. They find other ways to resolve such issues, such as mediation in real estate, which can be a good alternative to litigation. How it’s done Mediation in real estate is the interactive process where parties involved in the dispute are encouraged to participate to reach a solution amicably. Do note that it is a voluntary process that does not obligate anyone to agree on a settlement. Should you consider mediation to resolve a real estate dispute, remember that the outcome is up to you, as you have control over it. The mediation process requires a trained mediator to facilitate. This professional must be an independent third party and their goal is to help the parties involved to reach an agreement, which must be suitable to all. How it differs from other resolution processes Besides litigation, negotiation and arbitration may be considered by some parties. However, these are different from mediation in real estate. With negotiation, parties meet to discuss the settlement for the dispute, either on their own or with an attorney outside the court. Arbitration is similar to this, but it is private and not conducted under formal procedures or rules of court. Parties must have previously entered into an agreement before arbitrating their disputes.
