  2. BACKGROUND The judiciary, the custodian of the Constitution, has also failed in securing it, and its role has remained debatable due to many dubious judgments. Previously, several chief supreme court judges allegedly appointed specific judges to benches in cases of national and political importance. Furthermore, senior judges of High Courts are disregarded when appointing subordinate judges to the Supreme Court.

  3. JUDICIARY AND THE VOTE OF NO CONFIDENCE In April 2022, the opposition's motion of no confidence against Prime Minister Imran Khan was rejected by the deputy speaker of the house on the grounds that it was a "foreign conspiracy," which has caused a constitutional crisis in Pakistan.

  4. JUDICIARY AND THE PUNJAB BY-ELECTIONS The PTI won 15 out of 20 seats in the Punjab by- election. Still, the Punjab Assembly Deputy Speaker Dost Mazar rejected ten votes of PML(Q) under Article 63(A), and Hamza Shehbaz got three votes victory over Pervaiz Elahi (who was backed by PTI). The PML-Q filed a petition against Mazari's verdict, which allowed Hamza Shahbaz to retain his position as chief minister of Punjab.

  5. WAYFORWARD The legislative must take action to reclaim its constitutional authority from the judiciary, which it regrettably now has. It is crucial that the boundaries set are upheld and enforced, and strict accountability rules are created with equal applicability for all branches of the government. It should be illegal to deviate from the designated role.
