Same-sex marriage recognition hearing postponed due to indisposition of two Constitution bench judges ❖ On April 20, 2021, the petitions regarding the recognition of same-sex marriage were heard but left inconclusive. The matter was then listed for hearing by the Constitution bench on April 24 (today) which was postponed due to the indisposition of two judges. Read full update 2. Supreme Court marks 50 years of Kesavananda Bharti case, CJI announces dedicated webpage ❖ Today, April 24 is an important date to remember in the history of the Constitution as the landmark judgement of Kesavananda Bharati v. State of Kerala was pronounced (April 24, 1973). This landmark judgement of the Supreme Court outlined the “basic structure doctrine” of the Constitution of India. On the occasion of its 50th anniversary, Chief Justice of India (CJI) DY Chandrachud announced the formation of a webpage dedicated to the judgement. Read full update 3. “Judges have no business granting interviews on matters which are pending,” Supreme Court on Justice Abhijit Gangopadhyay remarks against Abhishek Banerjee ❖ Today, the Supreme Court of India was hearing the plea against the order passed by the Calcutta High Court judge Justice Abhijit Gangopadhyay regarding Primary Teacher’s Recruitment Scam. The judge directed the ED and the CBI to question TMC National General Secretary Abhishek Banerjee for the same. A division bench consisting of Chief Justice of India DY Chandrachud and Justice PS Narasimha orally remarked that judges did not have any right to give TV interviews on pending cases. Supreme Court accepts unconditional apology of Lalit Modi and closed Contempt of court proceedings ❖ On April 24, 2023, the Supreme Court of India accepted the unconditional apology tendered by ex-Commissioner Indian Premier League (IPL) Lalit Modi and closed the contempt proceedings. The contempt plea was filed by Senior Advocate Chander Uday Singh in relation to Lalit Modi’s social media post against the Indian judiciary. The bench comprising Justice CT Ravikumar and Justice MR Shah said “We accept the unconditional apology with broad heart because the Court always believes in forgiveness more particularly when an apology is tendered unconditionally and from the bottom of the heart…Accepting the apology we close the present proceedings.” Mr. Lalit Modi tendered an unconditional apology on his Twitter account on 18 April 2023, the apology reads as ….
