  2. On the basis of these, three controlling conditions are laid down by the Court in Nagaraj v. Union of India for considering SC/STs to be "backward" within the meaning of Article 16(4) in respect of promotion in Government services.

The Nagaraj verdict came in response to a petition filed by Swarna Bharathi, while representing Nagaraj, appealing for SC/ST reservation in promotion in the courts.

  4. Nagaraj vs. Union of India case • The judgment in the case of M. Nagaraj v. Union of India is considered one of the foremost decisions on second-generation reservation issues. This landmark decision dealt with the issue of whether the Backward Classes, which are covered by Article 16(4), can avail reservations in promotions in government service. • The following is a brief description of the case: The case which has been titled M. Nagaraj v. Union of India;  A.S. Krishna v. Union of India and others (popularly known as the NEET case), was decided in July 2012. Here, Mr. Nagaraj and Mr. Krishna were the petitioners before the Supreme Court and they had alleged that preventing States from conducting their own examinations for admission into professional educational institutions (particularly medical colleges) was discriminatory, which directly impacted either their chances for admission to these institutions or marginalized them.
