  5. Purpose The purpose of these Rules and Regulations is to establish an orderly and harmonious community and to remind us of our mutual responsibilities towards the attainment of these goals. These Rules and Regulations are in no way contrary to the Association Declaration or the By-Laws. Owners and tenants are required to familiarize themselves with and abide by all Rules and Regulations. All residents and guests shall abide by all established Rules and Regulations. Any complaints, violations and emergencies are to be reported to the current Management Company.

  6. GENERAL NUISANCES, OFFENSIVE OR ILLEGAL ACTIVITIES • No owner, tenant, or guest shall cause or permit any noise or condition in a Unit or on the Common Grounds that will or might disturb the peace, quiet, safety, comfort, or serenity of the occupants of surrounding Condominium Property. No illegal or offensive activity shall be carried on upon any portion of the Condominium Property, nor shall anything be done thereon tending to cause embarrassment, discomfort, annoyance, or nuisance to any person using any portion of the Condominium property. No owner, tenant, or guest shall permit any musical instrument to be played or shall operate a phonograph, television, radio, or stereo in the owner’s unit between the hours of 10:00 p.m. and the following 9:00 a.m. if that instrument shall disturb or annoy other residents of the building. Every owner and/or tenant shall use reasonable effort to minimize noise emanating from his/her unit.

  8. 2A. EXTERIOR APPEARANCE CONDUCT, AND MODIFICATION The following Rules and Regulations shall govern the use of the Condominium Property except as permitted by Section 5 of the Amended and Restated Declaration of Condominium and subject to those exceptions which may be approved from time to time at the sole discretion of the Board of Directors of Beneva Ridge Condominium Association, Inc.

  9. 2.1 EXTERIOR APPEARANCE, CONDUCT, AND MODIFICATION Any patio furniture behind the front fence is acceptable if not in plain sight. Electric grills and bicycles may be stored in the rear patio ONLY.

  10. 2.2 Entrance doors to units and exterior storage room/utility room shall not be changed or altered in any manner.

  11. h 2.3 No materials such as blankets, laundry, etc. are to be hung on patio fences.

  12. 2.4 Window air conditioning units are not permitted in any windows.

  13. 2.5 All units shall be and remain of like exterior design, shape, color, and appearance

  14. 2.6 No signs, advertisements or notices shall be exhibited, painted, or affixed on any part of the outside of the premises of the building or displayed in windows or on common areas by any owner and/or tenant.

  15. 2.7 No awnings, enclosures, shutters or other protective devices shall be attached to the outside walls of the buildings, patios, or lanais. The exterior appearance of the unit may not be altered except as provided by Section 5.3C of the Amended and Restated Declaration of Condominium.

  16. 2.8 The sidewalks and entrances shall not be used for any purpose other than egress from and ingress to the premises.

  17. 2.9 No littering on property such as cigarette butts, papers, bottles, can, etc. All such items are to be disposed of in the appropriate manner.

  18. 2.10 Mops, cloths, brooms, rugs and vacuum cleaning bags should not be shaken in any way that the contents fall or blow upon any individual or accumulate on common ground.

  19. 2.11 All refuse shall be tightly wrapped and fastened in plastic or paper bags before depositing in designated disposal containers. Extra care should be taken to ensure that all refuse is placed INSIDE disposal containers and NOT outside or around the container. No lighted cigarettes, ashes, or other items that could cause a fire should be placed in the containers. Boxes are to be broken down before being placed in the appropriate recycle bin.

  20. 2.12 Failure to maintain, clean, or repair scratches, tears, or blemishes on all doors and windows and screens will result in a fine. (Refer to Section 14.6 of the Amended and Restated Declaration of Condominium, and Article6(P) of the Beneva Ridge Amended and Restated Bylaws.

  22. 2.B. EXTERIOR MODIFICATION 2.1 No exterior modifications including fences, patios, and other exterior changes are to be made without written approval of the Board of Directors. The request will include plans, specifications, and an agreement to repair any damages caused by the proposed construction or modification

  23. To simplify the request procedure and to maintain architectural harmony, the following specifications and procedures for exterior modifications are established.

  24. SCREEN DOORS – Approved bronze or black screen doors are required. Screen doors should be kept shut at all times.

  25. FENCES – All fences shall be of the same style as the existing “good neighbor” fences; i.e., have the same appearance on both sides. The specifications are as follows: 6’ high vertical shadow box 4 x 4 posts 4’ gate Design to be rectangular (no offset) Paint shall be brown in color (color code number may be obtained from the Association and purchased at Sherwin Williams) Application for fence may be obtained from the current Management Company or the Association, and must be approved by the Board of Directors. No fence installation is to commence without prior approval and notification to the current Management Company and Board of Directors.

  26. PATIO AND FRONT ENTRY WAY Unit owners may cover the concrete slab with synthetic lawn outdoor carpeting or tile, or painted in a neutral color and consistent pattern. The rear patio may not be painted.

  27. FRONT DOORS All front doors that are replaced, repaired, or repainted shall be painted with Beneva Ridge paint (color code number may be obtained from the Association.)

  28. SCREENED LANAIS All lanais will be the same style and design as approved by the Board of Directors dated 12/12/78. The copy of the plan for each unit size is available from the current Management Company or the Association. A lanai construction permit request is available from the current Management Company or the Association and must be approved by the Board of Directors before commencement of construction. No lanai construction is to be commenced without the supervision of the current Management Company and Board of Directors.

  29. 2.2 Any exterior and interior structural modifications are to be submitted in writing to the current Management Company and must be approved by the Board of Directors before commencement of construction or modifications.

  30. SWIMMING POOL 3.1 The swimming pool and pool area shall be open from dawn to dusk and only persons over 18 years of age may use it after 8:00 p.m. Pool closes promptly at 9:00 p.m.

  31. 3.2 Children under the age of 16 are not permitted in the pool area unless supervised and accompanied by a parent, legal guardian, or designated adult 21 years or older. One adult may not be responsible for more than three (3) children under the age of 16.

  32. 3.3 All persons using the pool shall do so at their own risk, and in accordance with the rules. Owners and Association Board of Directors are not responsible for accidents or injuries.

  33. 3.4 The Association reserves the right, through the Board of Directors or authorized agent to enforce pool rules and any person who refuses to abide by stated rules will be subject to loss of pool privileges and/or fine.

  34. 3.5 Guests, other than houseguests, are limited to two (2) per family.

  35. 3.6 Owner shall be responsible for conduct of tenants and their guests, and any guests of owners and/or tenants must be accompanied by owners or tenant.

  36. 3.7 Diaper age persons must wear a cloth diaper, plastic pants, and swim suit. Paper diapers are NOT permitted as they are inadequate to prevent any waste from being deposited into the pool which may result in pool closure or emergency pool service. Residents will be responsible for all damages caused by their own acts or omission, as well as those of their guests and children.

  37. 3.8 Proper swim attire is required — bathing suits only, no cutoffs 

  38. 3.9 Do not substitute artificial support items for swimming such as floats, tubes, rafts, etc. They are NOT permitted. Only essential supports attached to the body may be used.

  39. 3.10 Stay out of the water during electrical storms.

  40. 3.11 A shower MUST BE TAKEN BEFORE ENTERING POOL.

  41. 3.12 No one with skin, eye, nose, or throat infections or any communicable ailment which might affect others or pollute the water is allowed to enter the pool.

  42. 3.13 SUNTAN OILS AND LOTIONS MUST BE REMOVED BEFORE ENTERING THE POOL. Not removing the accumulation of these oils causes buildups that will necessitate periodic pool closings for cleaning.

  43. 3.14 Food, glass containers, coolers, and alcoholic beverages are not permitted in pool area per Florida Statute.

  44. 3.15 No running, dunking, shoving, rough play or diving into the water is permitted.

  45. 3.16 Pool safety equipment IS TO BE USED FOR EMERGENCY ONLY.

  46. 3.17 Ladders and steps should be used for entering and exiting the water only.

  47. 3.18 No balls of any kind are permitted in the pool or pool area.

  48. 3.19 No pets are permitted in the pool or pool area.

  49. 3.20 Only radios or tape players with headsets are permitted be used in pool area.
