Freedom of Speech Test • The Supreme Court will follow a three step test when reviewing Speech Laws • Does the law fall under the Jurisdiction of the Constitution • Narrowly drawn to further a substantial gov’t interest that is unrelated to the suppression of free speech • Leaves Open ample alternative channels of communication

  4. Regulating Speech • Seditious Speech: Urging resistance to lawful authority, there three kinds of seditious speech: • Clear and Present Danger • The Bad Tendency Doctrine • Preferred Position Doctrine

  5. Clear and Present Danger • The speech presents an immediate danger. If public safety is put at risk by freedom of speech it is not protected • Examples:

  6. The Bad Tendency Doctrine • Speech can be restricted if it presents a tendency that could lead to illegal activity • Examples:

  7. Preferred Position Doctrine • The freedom of speech holds a preferential positron over other rights and laws. Freedom of speech will be protected over other competing interests. • Examples • The Sedition Laws
