  1. Temporary Storage of Recyclable Materials February 5, 2009

  2. Purpose • To provide an overview of Ministry approval requirements for the temporary storage of recyclable materials.

  3. Current Conditions • The Ministry is aware of the effect that the recent global economic situation has had on the recycling business. • Municipalities and industry are faced with recycling operations which have reduced the amount of recyclable materials that they are able to receive, making it difficult to find recycling destinations. • Dropping commodity prices have reduced the amount of revenue received when recycling facilities are identified. • Municipalities and their service providers continue to monitor the situation and consider all of their options. • The Ministry is committed to working with municipalities and their service providers as they deal with this situation.

  4. Options Available for Temporary Storage • Option 1: Storage at Off-Site Locations • Option 2: Storage at Existing Waste Disposal Sites • Option 3: Storage at New Waste Disposal Sites

Option 1: Storage at Off-Site Locations • May be done without a Certificate of Approval provided that: • Only approved blue box materials are stored (specified in O.Reg. 101/94); • All materials have been source separated (no commingling or processing); • All materials must be legitimately destined for recycling; and • The site is operated in accordance with standards set out in O.Reg. 101/94. • While there is no time limit for storage, should materials degrade over time to the point where they can’t be recycled, then they must be removed from storage and managed at a facility with a Certificate of Approval. • All sites must operate in compliance with all applicable laws (e.g. zoning, Fire Code) and in a manner that does not result in an adverse effect.

  6. Option 2: Storage at Existing Waste Disposal Sites • This would typically occur at existing municipal transfer, processing or landfill facilities. • Since these facilities will operate under the authority of a Certificate of Approval (CofA), any storage must be done in compliance with each site’s CofA. • If the storage can be done within the limits set in the site CofA, no further approvals are required. • If additional capacity is required, then an amendment to the CofA is required.

  7. Option 3: Storage at New Waste Disposal Sites • This would normally be done in situations where storage in under Options 1 and 2 and not viable. • One example would be where municipal facilities are physically unable to accommodate additional storage and it is necessary to store commingled waste or waste that has degraded over time (e.g. cardboard). • These site require Certificates of Approval as a waste disposal site.

  8. Applying for a Certificate of Approval • Submit applications before you require them. Some degree of public consultation is required, either through EBR posting or notification of neighbours. EAAB will treat these applications as a priority, however, they will take some time to go through the process. • Submit complete applications that describe in as much detail as possible what you are applying for. • Our review will focus on environmental impacts and the potential for storage to impact existing facility operations, so try to anticipate what those are and address them in your application. • Talk to us; either through your local District Office or EAAB directly. This not only ensures that we are aware of your incoming application and can identify it as a priority, but also allows us to properly understand your request and for you to understand our process.

  9. Suggestions to Consider • Establish ongoing dialogue with the Ministry, either through the District Office or EAAB. • Talk to other agencies that might have an interest in these facilities (e.g. Fire Department). • Think ahead and develop contingency plans before you need them This is particularly true if Certificates of Approval are required. • A FACT sheet explaining Ministry approvals requirements has been developed and will be circulated to stakeholders including, OWMA, MWIN and MWA. • If you have questions about your particular circumstance, my contact information is: Ian Parrott, P.Eng.
