  2. Local IDEA Accountability Process Six year plan. Originally submitted Dec. 2005. Established original targets, benchmarks and improvement activities. State Performance Plan Indicators and Targets Annual report of LEA performance on targets and benchmarks established in SPP. LEA Data Reports Annual evaluation of LEA’s compliance status. Includes review of timely correction of N/C, timely/complete reporting, LEA status in compliance indicators, and audit findings. LEA Compliance Determinations Compliance determinations are used to identify LEAs for monitoring, for monitoring plans, and to identify needs for sanctions as specified in IDEA Monitoring Sanctions

  3. The IDEA requires that CDE publicly report on the first 14 indicators at the district level. • Six are compliance indicators and eight are performance indicators. • The compliance indicators must be used as a part of the LEAs compliance determination

  10. Overall Determinations 34 CFR 300.603 (b) Determination—(1) General. Based on the information provided by the State in the State’s annual performance report, information obtained through monitoring visits, and any other public information made available, the Secretary determines if the State— (i) Meets the requirements and purposes of Part B of the Act; (ii) Needs assistance in implementing the requirements of Part B of the Act; (iii) Needs intervention in implementing the requirements of Part B of the Act; or (iv) Needs substantial intervention in implementing the requirements of Part B of the Act.

States Must Consider • Performance on compliance indicators; • Whether data submitted by LEAs/EIS programs is valid, reliable, and timely; • Uncorrected noncompliance from other sources; and • Any audit findings. • In addition, States could also consider: • Performance on performance indicators; and • Other information.

  14. As Required by IDEA, CDE prepares a Compliance Determination for each district. It includes consideration of Compliance Indicators: #9 – Disproportionality #10 – Disproportionality by Disability #11 – Initial Assessment # 12 –Transition at age 3 # 13 – Secondary Transition Timely Correction of Noncompliance Timely and Accurate Reporting Audits xxxxxxxxxxxxxxxxxxxxxx xxxxxxxxxxxxxxxxxxxxxxxxxxxx

  15. The Compliance Determination Letter contains a summary table with information about each of the indicators evaluated to make the overall Compliance Determination: Data, Score, and Indicator Determination xxxxxxxxxxxxxxxxxxxxxxxxxxx xxxxxxxxxxxxxxxxxxxxxxxxxxx

  16. The district is also sent information about calculation of the data and the criteria used to rate each indicator.

  17. The table also includes information about Timely Correction of Noncompliance, Timely and Complete Reporting, and Audit Findings. The overall score is the average of all the areas with a score.   18. The determination of timely and complete recording is based on another table that captures information about data that must be submitted to CDE. SELPA level reports are associated with all of the districts in the SELPA.

  19. Each report submitted is rated for timeliness and completeness on the due date and receives a “1” or a “0”. The overall percentage is based on the sum of 1’s and 0’s divided by the number of cells with a rating.

  21. Transition from Part C to Part B

  22. § 300.124 Transition of children from the Part C program to preschool programs. The State must have in effect policies and procedures to ensure that—… (b) By the third birthday of a child described in paragraph (a) of this section, an IEP… has been developed and is being implemented for the child consistent with § 300.101(b); and (c) Each affected LEA will participate in transition planning conferences arranged by the designated lead agency under section 635(a)(10) of the Act. (Authority: 20 U.S.C. 1412(a)(9))

  23. § 300.101 Free appropriate public education (FAPE). • (b) FAPE for children beginning at age3. • (1) Each State must ensure that— • The obligation to make FAPE available to each eligible child residing in the State begins no later than the child’s third birthday; and • (ii) An IEP… is in effect for the child by that date, in accordance with § 300.323(b). • (2) If a child’s third birthday occurs during the summer, the child’s IEP Team shall determine the date when services under the IEP… will begin.

Transition from B to C – Where does the data come from? • June CASEMIS – it has records for all of the students who were assessed during the year. • Transition from Part C to Part B • CDE matches data about all three year olds in CASEMIS with a data set from DDP listing all infants/toddlers in Part C who turned three during the year. • CDE Uses A-13 BIRTHDATE, A-28 PRNT_CNST, A-29 INIT_EVAL, and A-31 TBDLAY to determine if the child’s initial IEP was completed on or before the 3rd Birthday or if there was an appropriate reason the child’s initial evaluation was late. • Children referred late (parent consent less than 60 days prior to, or any time after the third birthday) will not be considered part of the calculation

  27. Initial Evaluations

  28. § 300.301 Initial evaluations. (c) Procedures for initial evaluation. The initial evaluation— (1)(i) Must be conducted within 60 days of receiving parental consent for the evaluation; or (ii) If the State establishes a timeframe within which the evaluation must be conducted, within that timeframe; and (2) Must consist of procedures— (i) To determine if the child is a child with a disability under § 300.8; and (ii) To determine the educational needs of the child.

  29. § 300.301 Initial evaluations, cont’d (d) Exception. The timeframe described in paragraph (c)(1) of this section does not apply to a public agency if— (1) The parent of a child repeatedly fails or refuses to produce the child for the evaluation; or (2) A child enrolls in a school of another public agency after the relevant timeframe in paragraph (c)(1) of this section has begun, and prior to a determination by the child’s previous public agency as to whether the child is a child with a disability under § 300.8

Initial Evaluations – Where does the data come from? • June CASEMIS – it has records for all of the students who were assessed during the year. • Initial Evaluations • CDE Uses A-28 PRNT_CNST, A-29 INIT_EVAL, and A-30 EVLDLAY to determine if the child’s initial evaluation was completed within the 60 day timeline or if there was an appropriate reason the child’s initial evaluation was late. • This calculation is run for all children entering Part B – preschool to age 18
