DEVELOPMENT AGREEMENT: FINAL City Council Recommendations At a public hearing of October 2, 2007, the City Council approved first reading an Ordinance requesting to modify the Palm Harbor Golf Course Planned Unit Development Agreement. The City Council recommended the following in conjunction with the vote to approve. Golf Course Use –Do not limit use exclusively to golf course. Duration of Construction Activities – Extensions other than limited to approval of Land Use Administrator. Building Height – Limit height of architectural elements above roof. Final Restated Agreement Golf Course Use - Shall only be used as a public golf course and associated amenities and uses including, but not limited to, clubhouse facilities for the first 7 years after the Effective Date of this PUD Agreement. Thereafter, Parcel B shall be used for either a golf course or any other public recreational use, either passive or active, as may be approved by the City Council of the City without the requirement of or necessity for a public hearing; provided, however, that the use of Parcel B for an active recreational use other than a golf course shall be subject to the approval of the Developer. Duration of Construction Activities – Provisions for Extensions; City Council to Select– Land Use Administrator or City Council Building Height – States architectural projection elements (towers, flags, etc.) shall be in substantial conformity with Attachment “2”, Conceptual Architectural Character Exhibit

  7. DEVELOPMENT AGREEMENT SUMMARY Current Agreement 158 Golf Villa condominium units. 3 Single Family Residential Lots. Development within existing driving range/clubhouse area. Golf course to remain a golf course use. Golf Course property and residential development area under common ownership. Administrative Deviations: Planning Manager may administratively approve deviations up to 10% of the site design criteria, deviations of greater than 10% may be approved by the PLDRB. Construction to be completed within 5 years of the execution of the Agreement. Extension of the 5 year time period in increments of 2 years each granted by the Development Services Director where circumstances beyond the reasonable control of the Developer delay completion of the project and so long as the Developer is making a good faith effort to complete the project. Restated Agreement No additional residential development entitlements. Residential development within existing driving range and former clubhouse area. Establishes Parcel “A” as a residential parcel to permit a maximum of one-hundred fifty eight (158) golf villa units and associated amenities and three (3) single family residential lots. Establishes Parcel “B”, golf course, which may only be used as a public golf course. Golf Course property and residential development area under different ownership. Administrative Deviations: Planning Manager may administratively approve deviations up to 10% of the site design criteria, deviations of greater than 10% may be approved by the PLDRB. Construction on Parcel “A” (residential parcel) shall commence within five (5) years of the execution date of the Development Agreement. Extension of the time period in increments of 2 years each to be granted by the Land Use Administrator when it concludes that (i) circumstances beyond the reasonable control of the Developer delayed the satisfaction of, or from satisfying those conditions and (ii) the Developer is making a good faith effort to satisfy such conditions.
