In practice • Example: new car  • 1. insurance (compulsory for the owner of the vehicle, as soon as the vehicle goes on the public road or on a (private) place that is accessible to the public  contract + green card • 2. registration (a vehicle is allowed for traffic only when it is registered and if it carries the number plate delivered by the competent body) :  certificate of registration + plate

  4. Insurance • The State and some public institutions may be their own insurer • Information requested : personal data of the holder and the driver(s), description of the vehicle, driving licence, previous accidents • For 1 year (renewal of contract with tacit agreement) 

  5. Registration in Belgium Number plates are personal linked to the owner of the car Registration is subordinated to the cover of TPL insurance The competent body delivering plates = DIV, depending upon the Ministry of Mobility and Transport

  6. Registration : exceptions • Mopeds • Trailers of which the maximal authorised mass does not exceed 750 kg • Vehicles used by the Ministry of Defence • Farm or forest trailers (except if used for transport on the account of others) • Vehicles on rails  • …

  7. How to registrate a vehicle ? • pink application form (*) with • details about the owner of the vehicle • a description of the vehicle • the seal of the insurance company (bar code) • the customs clearance label and the VAT label (delivered by the car dealer) • details about the maker/dealer of the vehicle • only for second-hand vehicles: proof of technical check (*)delivered by the firm which delivers the vehicle, or by the insurance company, or by a station of technical check of vehicles, or by the authority itself

  8. Who registers a vehicle ? • The insurance undertaking • The broker • The owner of the vehicle (at the DIV) 50% by the Internet 

  9. Deregistration • When no longer in possession of the vehicle because of theft (certificate from the police), total loss or sale (4 months) • When no longer in possession of the number plate : certificate of involuntary dispossession (delivered by the police)

  10. The Information Center • Insurers: information on TPL contracts transmitted at least once a month (via e-mail, CD-Rom or FTP) • DIV : information on registration transmitted each Monday (on CD-Rom, soon via FTP)

  11. Key of the database = number plate (or chassis number) • Starting point of a search = number plate (or chassis number)  DIV file  vehicle and its owner • Search in the TPL contracts  vehicle and the policy holder

The premium fixing BureauBT AUTO • Why ? • Some people can no longer find a cover on the market (accidents, problems of payment,…) • What ? • Proof of 3 refusals • Application form • Document from the previous insurers about accidents • Result ? • Offer • Conditions (driving ability test) • 1 year contract • Contract managed by an insurance company

Detection of uninsured vehicles • When ? • Requests for identification for which the insurer could not be found out • Terminations of contracts not followed by a new insurance contract • Offers from the « premium fixing » Bureau not followed up by the person who resorted to this Bureau • Vehicle still registered • What ? • Letter to the owner of the car (1 month) If uninsured : vehicle reported to the police If insured : the database is updated

Advantages of the system • Often, owner = policy holder  comparison between file of DIV and insurers’ files is easier • The same body (Guarantee Fund) manages the database (requests for identification, detection of uninsurance, BT auto)  the database is easily and permanently updated; the different activities complement one another

  15. Weaknesses of the system • The number plate is not an essential element for the insurers. • Some vehicles are not registered (e.g.: mopeds, but it is likely to change soon). • If the plate of a vehicle has been de-registered but the vehicle is still used : not found out by our service.
