  12. 6700.0700 Minimum Selection Standards 1. A citizen of the United States of America. 2. Possess a valid drivers license. 3. Complete a comprehensive written job app 4. May not be a convicted felon. 5. May not be convicted of certain misdemeanors. 6. May not be a registered Predatory Offender. MN POST Board

  13. 6700.0700 Minimum Selection Standards 7. Finger prints must be submitted to BCA and FBI. 8. Must be examined by a physician or surgeon. 9. Must be examined by a licensed psychologist. 10. Participate in an oral interview 11. Complete a job related physical strength and agility examination. (May be part of physical.) MN POST Board

  14. Thorough Background Investigation • The applicant shall submit to a thorough background investigation….. • “Thorough” not defined in statute • POST Board agreed on (5) actions that must be completed: • MN STAT § 626.87. MN POST Board

  15. POST Requires: • Document Minimum selection standards • State/Federal criminal history • Local criminal history • Interview previous employers & PPOE • Interview neighbors, classmates, co-workers etc. • CLEO’s have discretion to do more MN POST Board

  17. Compliance Reviews 626.8459 “Each year the Board shall conduct compliance reviews on all law enforcement agencies.” • Annual compliance review • Goal: 90 visits per year. Visit all agencies every 5 years. MN POST Board

  18. Policy & Training Compliance (Annual) 2 forms are e-mailed to each CLEO on or about September 1st. Deadline for returning the forms is the last Friday in September. • Mandatory Policies in place? • Alleged Misconduct #’s/Dispositions? • Use of Force/Firearms/EVOC? MN POST Board

  19. On Site Compliance Review Notification • A letter is sent to your agency about 2-3 weeks prior to the review. • The letter is mailed to the agency. MN POST Board

  20. On Site Compliance Review • What will be reviewed? • Twelve policies mandated by the legislature. ( 11) if no part-time licensed officers • Initial and annual training records for Use of Force and Firearms for the previous calendar year. • Training Records for EVOC/Pursuit Driving. • Records indicating minimum selection standards.   21. Compliance Review • What if my policies are deficient? • The Coordinator will assist you in understanding where, why and how your policies are deficient, and how to correct them. • You will be given time to modify your policies. MN POST Board

  22. Compliance Review • Reminder for new hires: • Use of force and firearms training must be accomplished initially, before a peace officer is licensed and annually thereafter. • Not Skills Use of Force. • All training must meet the learning objectives set up by the POST Board. MN POST Board

  27. Compliance Review • If your records indicate you have not accomplished sufficient Use of Force and Firearms training for the previous calendar year. • Failure can result in adverse action taken against the CLEO’s license for failure to train. MN POST Board

Compliance Review • If records indicate peace officers have not adequately trained in EVOC/Pursuit, during the past five years, the CLEO will be asked to sign an Exemption Form. • This precludes the peace officer from operating a vehicle while activating lights and siren, until the training is accomplished. • The board may impose licensing sanctions on the CLEO’s license. Compliance ReviewPart-time Peace Officer Records • Monthly logs, maintained by Part-time Licensed Peace Officers pursuant to MN Rules 6700.1115subpart 2. • Documentation covering the previous 24 months. (1,040 Hrs. calendar year) • These records are the responsibility of the part-time licensee, we are only asking that you have them available. (Not your responsibility to maintain!) MN POST Board

  33. 6700.0800 • CLEO shall notify the board before the first day of appointment as a peace officer. • Person may not exercise peace officer powers until the notification form is approved by POST. MN POST Board

  35. 6700.0800 • If the person is not already a licensed peace officer, he / she shall apply to be licensed at the time of appointment. • Application shall be made on a form provided by POST. • The CLEO shall affirm the applicant is eligible to be licensed. MN POST Board

  38. 6700.1400 • Notification of terminations. • The chief law enforcement officer shall notify the board within 10 days of all voluntary and involuntary terminations of peace officers. MN POST Board

  40. 6700.1600 Standards of Conduct • In order for the public to have confidence in the integrity of law enforcement, it is paramount that peace officers demonstrate they are capable of self regulation. Violation of any of the following is grounds for disciplinary action… MN POST Board

  41. 6700.1600 Standards of Conduct • Obtaining a license by fraud…cheating on exam etc. • Being convicted of a felony or gross misdemeanor in MN or any other jurisdiction that would be a (F) or (GM) if committed in MN. • Having been the subject of a revocation, suspension or surrender of peace officer license in another jurisdiction. • Failing to report such revocation etc. MN POST Board

  42. 6700.1600 Standards of Conduct • Conviction of a controlled substance crime. • Being adjudicated as incapacitated, mentally incompetent, chemically dependent, mentally ill. • Or being required to register as a predatory offender. § 243.166 or 243.167 • Violating an order of the Board.   43. Practicing outside the scope of § 626.863 (unauthorized practice). • Making an intentional false statement or misrepresentation to the Board. • Engaging in criminal sexual penetration/contact § 609.341 and § 617.23 (indecent exposure). MN POST Board
