EPACT 1252 – New PURPA Standard • A new standard is created • Governing authorities of utilities are required to consider it • IOUs • Munis • Rural Coops • No requirement on utilities (18 months language notwithstanding) absent adoption • If standard is implemented, competitive retail customers entitled to same as others

EPACT 1252 – New PURPA Standard • What the new PURPA Standard says • Within 18 months of enactment, utilities should offer time-based rates/pricing and/or capacity-based incentives, and the advanced metering to enable such, to all customers • Timetable • Consensus of NARUC-Utility Association effort is generally accepted: • Start a proceeding by August 8, 2006 • Make a finding by August 8, 2007
