  2. Guaranteed Title System: components • A public record of Titles: conclusive • Entries in this record are guaranteed • Entries need to be always correct and true • 3 Principles - Curtain - Mirror - Insurance Torrens

Guaranteed Title System: Requirements • A central Registry of Titles over all properties • - final and conclusive • Accurate description of property - Cadastral surveys - Unique ID - Unified graphical and textual data • Title Registration System • Auto updating • - changes in record integral to transaction (no mutation)

Impediments in India • Deed Registration System:Registration doesn't convey title • No title records: Revenue records presumptive • Old and outdated, incomplete and inaccurate cadastral records – graphical + textual • Urban records & Registration: stand alone systems • Multiple handling agencies – lack of coordination • Gap between –RoR and registration • - Registration & RoR (mutation) • Mutation and sub division • Sub division and RoR

  5. Action needed • Describe all properties accurately • Resurvey/ supplemental survey • Create Register of titles: two alternatives 1. Public enquiries and recording 2. Incremental method • Provide ‘conclusivity’ – New law • Introduce Title Registration System • Create unified delivery system – one agency to handle ‘records’, ‘registration’ and ‘survey’ • Single system for all areas - urban and rural, agricultural and non agricultural • Re engineer processes

Current Status of Bhu Bharati • Concept approved by state government and orders issued for state wide implementation • Pilot project for one district: Nizamabad • Objectives : Proving the concept : Firming up of processes and applications : Firming up of legal framework and procedures • Cost : 33.85 crores • Area : 8,000 sq.km • Pilot in advance stage of implementation : to be completed by July, 2008

  8. Proposal • To roll out the project for entire state • Covering all the 22 Districts in 4 phases • 4 to 6 Districts in each phase • Commencing this year • To be completed by July, 2012 • Covering 37 mn properties : Project cost - $400 mn
