Interim Guidance Summary • Exempt Projects or Projects with no Meaningful Potential MSAT Effects • No analysis – document in the project record • Projects with Low Potential MSAT Effects • Conduct a qualitative analysis • Conduct a 40 CFR 1502.22 assessment (CEQ Uncertainty Provisions) • Projects with Higher Potential MSAT Effects • Conduct a quantitative emissions analysis • Conduct a 40 CFR 1502.22 assessment (CEQ Uncertainty Provisions) • Evaluate mitigation if meaningful differences in MSAT emissions identified

What’s Happened Since February 2006 Interim Guidance? • March 2007 EPA Final MSAT Rule • SAFETEA-LU Part 6002 Regulations Developed • Research – HEI, EPA & FHWA National Near Road Study, etc. • Reports – NCHRP, IECR Assessment, AASHTO COP • Technical Outreach, Training and Assistance • New Model from EPA – draft MOVES

  7. Rules and Laws EPA Final MSAT Rule (Federal Register, Vol. 72. No. 37, February 26, 2007) • Set new engine and fuel standards • Identified seven compounds with significant contributions from MSAT SAFETEA-LU (Title VI - Transportation Planning and Project Development) • Emphasis on Streamlining • Emphasis on Coordination and Early Collaboration with agencies

Scientific Research on Air Toxics EPA & FHWA National Near Road Study • Monitoring in Las Vegas began December 2008, Southeastern Michigan monitoring to begin in Spring 2010 HEI • Mobile-Source Air Toxics: A Critical Review of the Literature on Exposure and Healthy Effects, Special Report 16 (2007) • Hundreds of other reports reviewed and analyzed

Papers and Reports NCHRP • Analyzing, Documenting, and Communicating the Impacts of Mobile Source Air Toxic Emissions in the NEPA Process (March 2007) IECR Assessment • Summarized issues of agreement and differences between FHWA and EPA • Suggested possible avenues for improved communications • Identified significant challenges both agencies face AASHTO COP • Identify research needed • Identify various analysis techniques implemented throughout US

State DOTs • California – Modified FHWA Guidance, with strong state Environmental documentation laws • Colorado – FHWA Guidance with an MOA to help reduce all types of transportation related air pollution statewide • Texas – Modified FHWA Guidance with an emphasis on making sure to get early feed back and provide analysis when requested, not only at certain thresholds

NATIONAL TRENDS IN MOBILE SOURCE AIR TOXIC EMISSIONSAND VEHICLE-MILES TRAVELED (MOVES) DraftMOVES2009 Highway Components NOTE: Emissions of Polycyclic Organic Matter (POM) are less than 600 tons/yr based on MOBILE6.2 projections. DraftMOVES2009 does not have the capability to compute POM emissions.

Summary • Laws, regulations, public concern • FHWA Interim Guidance • FHWA goal - Make MSAT analysis useful for decision makers • Research, regulations, and reports funded and/or released • EPA, FHWA, State DOTs, and private institutions want to fulfill their mission, provide valuable information to decision makers. This is accomplished by sharing information about what’s worked in other areas, and funding research in the areas where expertise is not readily available • Changes will keep coming • Challenges will remain
