  3. Process: • Bargaining preparation for this round began over a year ago. • Bargaining team met locally with the employer in December, January, February, March, and April. • Provincial Template Table met the last week of January.

  4. Categories of Proposals • Fair and Reasonable Salary Increase • Improvements for Non-Regular Faculty • Benefit Improvements • Pension Improvements • Improvements to Job Security • Resources to deal with Local Cost Issues (i.e. Workload issues)

  6. Term of the Agreement • April 1, 2012 – March 31, 2014

  7. Article 2 Harassment Article 2.1 Statement of Commitment • The final paragraph of the Article speaks to the employer offering education and training programs. This sentence was added: • The Unions and Employers agree that attendance is required and will take place during compensated work time.

  8. BC Provincial PharmaCare Formulary • While not to be included in the local parties’ collective agreements, FPSE and PSEA agree to continue discussions and investigation of the BC Provincial PharmaCare Formulary.

  9. Expedited Arbitration • Dismissals • Suspensions in excess of 5 days • grievances requiring • substantial interpretation of the agreement • presentation of extrinsic evidence • where a local party intends to raise a preliminary objection • arising from duty to accommodate • interpretation of the Common Agreement unless mutually agreed Letter of Understanding After exhausting the steps of the grievance procedure, either party may notify the other of its desire to use expedited arbitration. The following are excluded:

Expedited Arbitration (2) • A list of six arbitrators • Lawyers not to be retained • Agreed Statement of Facts • Written submissions no more than 10 pages • Arbitrator may assist in mediating a resolution • Decision to be completed within 3 days • All decisions are without prejudice and have no precedential value • Decision is binding and conclusive

  11. Common Faculty PD Plan • 16.3.2 Any monies in the Fund not spent at the end of any fiscal year shall be retained by the employer.

Respectful Working Environment • Letter of Understanding • Jointly develop and offer mandatory educational and training programs at each institution, designed to: • Enhance understanding of interpersonal conflict, bullying, and the effects thereof. • Ensure all members are aware of resources and responsibilities • Actively promote a respectful working environment

  13. Salaries • January 1, 2013 1 percent • April 1, 2013 1 percent • September 1, 2013 1 percent(or ratification if later) • January 1, 2014 1 percent • All secondary scales and stipends will be increased at the above rates

  14. Sectoral Non-Regular Research Project • PSEA agrees to assist FPSE in the collection of data from the HRDB and PSEA member institutions regarding non-regular faculty.

CORFA Local Agreement PSEA imposed several “mandates” for local bargaining including: • No decrease to faculty workload; • No limits on student numbers; • No decrease to any Management rights; • Anything with a cost had to be “paid for” by giving up some other existing local agreement benefit.

CORFA Local Agreement • Article 5 Working Conditions • 5.2.1.1 – 206 duty days changed to 205 (because of the new stat holiday) • 5.2.2.5 – A regular employee will normally be provided with 12 consecutive hours off duty following an evening teaching assignment (new) • 5.6.1.2 – This article talks about which University Studies/Career Tech contact hours are discounted. It still includes labs, practicums, workshops and field activities. Added clinical practice and studios. Deleted intro phrase ending with 1994. • 5.62.1 – Previously just stated maximum US/CT hours are 480. Added Normal assigned contact hours in University Studies is 450.

CORFA Local Agreement • Article 5 Working Conditions cont. • 5.6.2.2 – Assigned contact hours greater than 450 is overload • 5.6.4 – Preparation Hours of Work - Just a title change – added the words: for University Studies and/or Career Technology Courses • 5.6.4.1 –Preparation hours per Week • a) added to a weekly maximum of 15 contact hours as per 5.6.3.1 • b) added the 4 x4 language • 5.6.4.2 – New language - added calculation of part-time work

  18. CORFA Local Agreement • Article 5 Working Conditions cont. 5.7.1 – changed duty period to 37 weeks including statutory holidays This was a long discussion. Here’s the math: 261 potential work days in a year. 44 of these are vacation 20 of these are PD. 10 of these are NI. 12 are stat holidays. Maximum of 175 work days = 35 weeks. But, the period of the work days may stretch out as long as 37 weeks because stat holidays, PD and/or NI days may be part of this period.

CORFA Local Agreement • Article 5 Working Conditions cont. • 5.7.3 – The restriction of a maximum of 18 lecture hours per week in Vocational workloads was clarified to only apply to Access Education Instructors. • New 5.8 – moved language from 7.2.2.1 and 7.2.2.2 regarding hours for auxiliary vocational instructors

  21. CORFA Local Agreement Article 6 - Selection and Appointment – Housekeeping changes What we didn’t get in Article 6: • Didn’t get to change accrual of work to our proposed seniority and qualifications based system. Employer would not agree to it.

  22. CORFA Local Agreement Article 7 Salaries and Premiums • 7.3.1 Increments - Housekeeping • 7.7 Instructor’s Diploma – moved from article 5.6 Salary Increments were dealt with a Template Table We weren’t able to get rid cap on the auxiliary salary scale.

  23. CORFA Local Agreement Article 8 Reimbursable Expenses • Article 8.1.2.1 Vehicle • Edited paragraph to include rental vehicle and clarify the College will pay all related expenses. Employees must choose most economical transportation and have travel preapproved

  24. CORFA Local Agreement Article 9 Employee Benefits • No substantive changes to employee benefits • Article 9.3 Statutory Holidays – added Family Day • Article 9.7 Employee Benefits – Housekeeping change - replaced Etc with Dismemberment

  26. CORFA Local Agreement • Article 11 Leaves of Absence • Moved Article 6.5 Voluntary Workload Reduction to this Article, to go with other Leaves. It is now Article 11.8

CORFA Local Agreement Article 13 Employee Layoff and Recall and Technological Change. 13.1.5 Housekeeping Functional Area List – removed formerly names What we weren’t able to get: We were not able to eliminate functional areas and implement our new proposed system of seniority and qualifications.

CORFA Local Agreement • Letters of Agreement – Amended • Distributed Learning • Refer to Common Agreement Article 6.6 – Education Technology/Distributed Learning • The parties agree that the contact hours per week for delivering a course shall be the same regardless of whether it is offered in distributed learning or lecture format. • The remainder of the LOU was deleted because Article 6.6 supersedes local agreement language.

Kept the 5 by 4 language with all its restrictions.

CORFA Local Agreement • Letters of Understanding – Amended • Global Studies Graduate Certificate Program • A general advertisement will be posted prior to each academic year. • Mutual agreement for assignment deleted because of posting process. • Student preference removed from faculty selection criteria. • Pilot term and review process deleted.

CORFA Local Agreement • Letters of Understanding – Amended • Workload for BBA Capstone stays at 1.5 contact hours per student per credit. • Removed reference to 2011-2012 academic year • Removed hours for coordinator to ensure courses are ready • Letter of Understanding – New • Special Projects • Faculty assigned to special projects instruction will be assigned 4.5 contact hours per student in an individualized 3-credit course, pro-rata. • The contact hours are not distinctly different lecture form contact hours and are not considered prep hours as defined under Article 5.6.4

Vote: • The CORFA Bargaining Committee recommends acceptance of the tentative Provincial Template Table agreement and the tentative local agreement • Ballots will be available following the meeting as well as tomorrow from 8 a.m. to 7 p.m. at the Cranbrook campus. Campuses each have a volunteer voting captain.
