Nassau-Suffolk, NY - Mold is causing problems for homes, businesses and apartment complexes all over the state of New York with employees and tenants struggling to find a solution to their problems. What many do not know is that there is help available by simply picking up the phone and making a complaint. A tenant or employee has the right to live or work in a safe and clean environment free of any potentially dangerous materials such as mold, asbestos, and any other materials that may be hazardous to your health or the health of your family. If your home or place of employment has been effected by mold or any other perilous materials it is advised to call the online mold information hotline at 311 for advice on how to continue. A law put into effect to help tenants and employees exposed of potentially dangerous health effects. New York Real Property Law, Article 7, § 235-B. "The premises so leased or rented and all areas used in connection therewith in common with other tenants or residents are fit for human habitation and for the uses reasonably intended by the parties and that the occupants of such premises shall not be subjected to any conditions which would be dangerous, hazardous or detrimental to their life, health or safety."

  2. While this law is in effect for all of New York, there are steps needed to be taken in order to invoke this law. Before calling the mold information hotline the tenant or employee should first contact the owner or property manager with the problems allowing them sufficient time to properly take care of the issues. If the owner or manager fails to properly address the problems the tenant or employee should seek further support by contacting the state regarding your tenant rights. In many cases the manager or owner is unaware of the situation and will quickly take care of the problem. If residents feel that the problem is too serious to be remedied, by law they are able to serve a 3 day notice to terminate the lease due to unsafe conditions.
