  3. TVWS Regulatory Issues • The Time is Now! (Not Exactly) • The FCC database specification is still undecided • For this to be an international standard, the Ofcom plan for their Digital Dividend must be included; their database is also in flux • A survey of other regulatory domains must be considered • We can’t “guess” at what the final plan(s) will be • The FCC must avoid potential enforcement nightmare • Want to maximize use of the spectrum, but enforcement resources will not be increased to deal with interference issues • Interference mitigation mechanism(s) must be in the standard • They don’t want to duplicate the problems encountered with… • Wireless microphones in the TV band Rich Kennedy, Research In Motion

Status of the Standards • IEEE 802.22 has been working on this for five years • The PAR covers only the outdoor, long-range (WRAN) devices • IEEE 802.22WG membership has been dwindling • IEEE 802.11 is well suited for the TVWS • Large-scale spectrum sharing has been extremely successful using 802.11 • 11b/g/n in the 2.4GHz band • 11a/n in the 5GHz bands; even successfully sharing with radars • With the 11y mechanisms it is prepared to cover the full range of TVWS requirements and needed interference mitigation • The 802.11WG has a long record of success and large active membership ready for this opportunity Rich Kennedy, Research In Motion

Recommendations • Recommend to the EC that non-specific SG activities have run their course; no further effort should be expended • The goal for development of a standard should be to enable the best social and commercial use of the band • Because of its suitability as the best candidate for a TVWS technology, and in the expectation that the FCC and Ofcom will clarify the requirements for the database in the interim, the 802.11WG should submit PAR and 5 Criteria documents for approval by the EC at the Atlanta Plenary in November 2009 Rich Kennedy, Research In Motion
