  4. Patriot Act 2001 • In the 107th Congress, 1st Session H.R 3162 the “USA Patriot Act” of 2001 was passed. In Section 802 of the Act Section 2331 of title 18, United States Code, was amended. The term “domestic terrorism” means the following: ‘‘(A) involve acts dangerous to human life that are a violation of the criminal laws of the United States or of any State; ‘‘(B) appear to be intended— ‘‘(i) to intimidate or coerce a civilian population; • ‘‘(ii) to influence the policy of a government by intimidation or coercion; or • ‘‘(iii) to affect the conduct of a government by mass destruction, • assassination, or kidnapping; and ‘‘(C) occur primarily within the territorial jurisdiction of the United States.’’ • The (b) Conforming Amendment. –Section 3077 (1) 0f title 18, United States Code, was amended as follows: “‘ (1) ‘act of terrorism’ means an act of domestic or international terrorism as defined in section 2331;’’.

  7. National Emergency Centers Act H.R. 645 (2009) • SEC. 2. ESTABLISHMENT OF NATIONAL EMERGENCY CENTERS. • (a) In General- In accordance with the requirements of this Act, the Secretary of Homeland Security shall establish not fewer than 6 national emergency centers on military installations. • (b) Purpose of National Emergency Centers- The purpose of a national emergency center shall be to use existing infrastructure-- • (1) to provide temporary housing, medical, and humanitarian assistance to individuals and families dislocated due to an emergency or major disaster; • (2) to provide centralized locations for the purposes of training and ensuring the coordination of Federal, State, and local first responders; • (3) to provide centralized locations to improve the coordination of preparedness, response, and recovery efforts of government, private, and not-for-profit entities and faith-based organizations; and • (4) to meet other appropriate needs, as determined by the Secretary of Homeland Security.

  8. National Emergency Act H.R. 645 • SEC. 3. DESIGNATION OF MILITARY INSTALLATIONS AS NATIONAL EMERGENCY CENTERS. • (a) In General- Not later than 60 days after the date of the enactment of this Act, the Secretary of Homeland Security, in consultation with the Secretary of Defense, shall designate not fewer than 6 military installations as sites for the establishment of national emergency centers. • (b) Minimum Requirements- A site designated as a national emergency center shall be-- • (1) capable of meeting for an extended period of time the housing, health, transportation, education, public works, humanitarian and other transition needs of a large number of individuals affected by an emergency or major disaster; • (2) environmentally safe and shall not pose a health risk to individuals who may use the center; • (3) capable of being scaled up or down to accommodate major disaster preparedness and response drills, operations, and procedures; • (4) capable of housing existing permanent structures necessary to meet training and first responders coordination requirements during nondisaster periods; • (5) capable of hosting the infrastructure necessary to rapidly adjust to temporary housing, medical, and humanitarian assistance needs;

  9. FEMA EXECUTIVE ORDERS • THE MOST POWERFUL ORGANIZATION IN THE UNITED STATES. • Though it may be the most powerful organization in the United States, few people know it even exists. But it has crept into our private lives. Even mortgage papers contain FEMA's name in small print if the property in question is near a flood plain. FEMA was deeply involved in the Los Angeles riots and the 1989 Loma Prieta earthquake in the San Francisco Bay Area. Some of the black helicopter traffic reported throughout the United States, but mainly in the West, California, Washington, Arizona, New Mexico, Texas and Colorado, are flown by FEMA personnel. FEMA has been given responsibility for many new disasters including urban forest fires, home heating emergencies, refugee situations, urban riots, and emergency planning for nuclear and toxic incidents. In the West, it works in conjunction with the Sixth Army. FEMA was created in a series of Executive Orders. A Presidential Executive Order, whether Constitutional or not, becomes law simply by its publication in the Federal Registry. Congress is by-passed. • Executive Order Number 12148 created the Federal Emergency Management Agency that is to interface with the Department of Defense for civil defense planning and funding. An "emergency czar" was appointed. FEMA has only spent about 6 percent of its budget on national emergencies. The bulk of their funding has been used for the construction of secret underground facilities to assure continuity of government in case of a major emergency, foreign or domestic.

  10. FEMA EXECUTIVE ORDERS • Executive Order Number 12656 appointed the National Security Council as the principal body that should consider emergency powers. This allows the government to increase domestic intelligence and surveillance of U.S. citizens and would restrict the freedom of movement within the United States and grant the government the right to isolate large groups of civilians. The National Guard could be federalized to seal all borders and take control of U.S. air space and all ports of entry. Here are just a few Executive Orders associated with FEMA that would suspend the Constitution and the Bill of Rights. These Executive Orders have been on record for nearly 30 years and could be enacted by the stroke of a Presidential pen: • EXECUTIVE ORDER 10990 allows the government to take over all modes of transportation and control of highways and seaports. • EXECUTIVE ORDER 10995 allows the government to seize and control the communication media. • EXECUTIVE ORDER 10997 allows the government to take over all electrical power, gas, petroleum, fuels and minerals. • EXECUTIVE ORDER 10998 allows the government to take over all food resources and farms. • EXECUTIVE ORDER 11000 allows the government to mobilize civilians into work brigades under government supervision.

FEMA EXECUTIVE ORDERS • EXECUTIVE ORDER 11001 allows the government to take over all health, education and welfare functions. • EXECUTIVE ORDER 11002 designates the Postmaster General to operate a national registration of all persons. • EXECUTIVE ORDER 11003 allows the government to take over all airports and aircraft, including commercial aircraft. • EXECUTIVE ORDER 11004 allows the Housing and Finance Authority to relocate communities, build new housing with public funds, designate areas to be abandoned, and establish new locations for populations. • EXECUTIVE ORDER 11005 allows the government to take over railroads, inland waterways and public storage facilities. • EXECUTIVE ORDER 11051 specifies the responsibility of the Office of Emergency Planning and gives authorization to put all Executive Orders into effect in times of increased international tensions and economic or financial crisis. • EXECUTIVE ORDER 11310 grants authority to the Department of Justice to enforce the plans set out in Executive Orders, to institute industrial support, to establish judicial and legislative liaison, to control all aliens, to operate penal and correctional institutions, and to advise and assist the President. • EXECUTIVE ORDER 11049 assigns emergency preparedness function to federal departments and agencies, consolidating 21 operative Executive Orders issued over a fifteen year period.

FEMA EXECUTIVE ORDERS • EXECUTIVE ORDER 11921 allows the Federal Emergency Preparedness Agency to develop plans to establish control over the mechanisms of production and distribution, of energy sources, wages, salaries, credit and the flow of money in U.S. financial institution in any undefined national emergency. It also provides that when a state of emergency is declared by the President, Congress cannot review the action for six months. The Federal Emergency Management Agency has broad powers in every aspect of the nation. • General Frank Salzedo, chief of FEMA's Civil Security Division stated in a 1983 conference that he saw FEMA's role as a "new frontier in the protection of individual and governmental leaders from assassination, and of civil and military installations from sabotage and/or attack, as well as prevention of dissident groups from gaining access to U.S. opinion, or a global audience in times of crisis." FEMA's powers were consolidated by President Carter to incorporate: The National Security Act of 1947, which allows for the strategic relocation of industries, services, government and other essential economic activities, and to rationalize the requirements for manpower, resources and production facilities; The 1950 Defense Production Act, which gives the President sweeping powers over all aspects of the economy; The Act of August 29, 1916, which authorizes the Secretary of the Army, in time of war, to take possession of any transportation system for transporting troops, material, or any other purpose related to the emergency; and The International Emergency Economic Powers Act, which enables the President to seize the property of a foreign country or national. These powers were transferred to FEMA in a sweeping consolidation in 1979.

Neither is there any law establishing its existence or setting out the rules by which it is supposed to operate. • The panel was behind the decision to add Awlaki, a U.S.-born militant preacher with alleged al Qaeda connections, to the target list. He was killed by a CIA drone strike in Yemen late last month. • The role of the president in ordering or ratifying a decision to target a citizen is fuzzy. White House spokesman Tommy Vietor declined to discuss anything about the process.” • Note: • To date three American citizens have been targeted and killed without due process! Who will be next?

  19. Senate Bill 1867 Sec. 1031 (2011) • Subtitle D--Detainee Matters • SEC. 1031. AFFIRMATION OF AUTHORITY OF THE ARMED FORCES OF THE UNITED STATES TO DETAIN COVERED PERSONS PURSUANT TO THE AUTHORIZATION FOR USE OF MILITARY FORCE. • (a) In General- Congress affirms that the authority of the President to use all necessary and appropriate force pursuant to the Authorization for Use of Military Force (Public Law 107-40) includes the authority for the Armed Forces of the United States to detain covered persons (as defined in subsection (b)) pending disposition under the law of war. • (b) Covered Persons- A covered person under this section is any person as follows: • (1) A person who planned, authorized, committed, or aided the terrorist attacks that occurred on September 11, 2001, or harbored those responsible for those attacks. • (2) A person who was a part of or substantially supported al-Qaeda, the Taliban, or associated forces that are engaged in hostilities against the United States or its coalition partners, including any person who has committed a belligerent act or has directly supported such hostilities in aid of such enemy forces. • (c) Disposition Under Law of War- The disposition of a person under the law of war as described in subsection (a) may include the following: • (1) Detention under the law of war without trial until the end of the hostilities authorized by the Authorization for Use of Military Force. • (2) Trial under chapter 47A of title 10, United States Code (as amended by the Military Commissions Act of 2009 (title XVIII of Public Law 111-84)). • (3) Transfer for trial by an alternative court or competent tribunal having lawful jurisdiction. • (4) Transfer to the custody or control of the person's country of origin, any other foreign country, or any other foreign entity. • (d) Construction- Nothing in this section is intended to limit or expand the authority of the President or the scope of the Authorization for Use of Military Force. • (e) Authorities- Nothing in this section shall be construed to affect existing law or authorities, relating to the detention of United States citizens, lawful resident aliens of the United States or any other persons who are captured or arrested in the United States. • (f) Requirement for Briefings of Congress- The Secretary of Defense shall regularly brief Congress regarding the application of the authority described in this section, including the organizations, entities, and individuals considered to be `covered persons' for purposes of subsection (b)(2).

REQUIREMENT FOR MILITARY CUSTODY. • (a) Custody Pending Disposition Under Law of War- • (1) IN GENERAL- Except as provided in paragraph (4), the Armed Forces of the United States shall hold a person described in paragraph (2) who is captured in the course of hostilities authorized by the Authorization for Use of Military Force (Public Law 107-40) in military custody pending disposition under the law of war. • (2) COVERED PERSONS- The requirement in paragraph (1) shall apply to any person whose detention is authorized under section 1031 who is determined-- • (A) to be a member of, or part of, al-Qaeda or an associated force that acts in coordination with or pursuant to the direction of al-Qaeda; and • (B) to have participated in the course of planning or carrying out an attack or attempted attack against the United States or its coalition partners.

Excerpts From a Letter Senator Harkin Sent Addressing S.1867 • First, the bill authorizes the President to indefinitely detain a terrorism suspect without trial and failed to make clear that under no circumstances can an American citizen be detained indefinitely without due process of law. I simply do not believe that a person should be seized on American soil and detained without charges and without due process of law. • Second, it mandates, for the first time, that non-American suspects arrested in the United States be detained by the military, rather than civilian law enforcement. Throughout our history, there has been a clear divide between our military, which fights wars abroad, and law enforcement in the United States. That divide has worked. For example, since 9/11, over 400 terrorists have been successfully convicted in civilian, not military, courts. • Again, nothing is more important to me than the security of our country, and I take the responsibility to protect our country very seriously. But, I believe we can protect our national security without compromising our core Constitutional values and principles. The Subcontractor shall be able to mobilize and deploy • key personnel(s) within four (4) hours of NTP to meet with KBR Site Manager at the Responder • Support Camp (RSC) site in order to finalize the site design plan and acquire site specific • design requirements and layout. • Number of linear footage: • Approximately 2,300LF for a 301 person camp after 36 hours of NTP • Approximately 3,600LF for 1,000 person camp after 72 hours of NTP
