  4. Estate Planning Estate planning is a multi-step process that involves making decisions about your assets and people throughout both life and death. Wills, trusts, durable powers of attorney, healthcare surrogates, and other advanced directives are all common components of estate planning. Asset protection planning is included in estate planning.

  5. Elder Law Elder law is a broad approach to ensuring that an ageing client has skilled decision makers, receives the proper care, and is able to pay for their health care and living expenditures. Elder law attorneys collaborate with health care specialists to develop a comprehensive plan that suits the needs of each elder. Elder can include, but is not limited to the following: • Estate planning (wills and trusts) • Incapacity Planning (durable power of attorney, health care surrogate) • End of life planning (living will) • Long Term Care (Assisted Living and Nursing Home Medicaid) • Veterans Benefits (Aid and Attendance) • Probate and Estate Administration

  6. Probate and Estate Administration Probate is a court-supervised process for dispersing your probate estate after your death. It only governs assets that go through this process if you have a final will and testament. Before the personal representative is discharged, a last will and testament is filed with the court, a personal representative is appointed, creditors are notified, an inventory is filed, creditors are paid, final accountings are submitted, and beneficiaries receive their payouts. Estate administration is supporting a family, typically a Trustee or Personal Representative "Executor," in dealing with each asset possessed by the decedent. This includes transferring ownership of IRAs, 401(k)s, and life insurance policies, as well as providing trust accountings and beneficiary distributions.

  7. Real Estate Hampton Law is available to assist with real estate closings. We are glad to assist with realtors, buyers, and sellers on title and escrow matters. Our combined efforts as a title and escrow business provide optimum protection against any risks that may arise throughout the closing process. Knowing that your closing documents have been examined by an attorney gives you more confidence and peace of mind about the deal.

  8. Special Needs Planning Special Needs planning involves planning for someone who is disabled to insure their quality of life is maintained as best as possible, even without family or friends around. For some, the words independence planning is a more appropriate term. We are striving to make the disabled person as independent as possible and not as dependent on the family.
