  4. Clarification Process Requests for clarification should be received earlier than 7 September 2015 All questions shall be addressed in writing to: Floris.Bonthond@cern.ch

  5. Clarification Process • CERN’s response will be sent to all bidders, including the request for clarification but without identifying its source • Bidders shall acknowledge receipt of the email • Cover letter with bid shall acknowledge each individual CERN clarification correspondence received

  6. Basis of Award The contract shall be awarded on a «Lowest compliant bid » basis

  7. Selection & Adjudication Criteria With a view to improving the distribution of its purchases among its Member States, CERN has applied, for the selection of bidders to be invited to tender, and will apply for the award of the contract to a technically and financially qualified bidder, the criteria set out in the document entitled Selection and Adjudication Criteria for Supply Contracts

  8. Country of Origin In accordance with standards defined by EU, i.e. the country(ies) where the supplies (including their components and sub-assemblies) are manufactured or undergo the last major transformation by the contractor or his sub-contractors

  9. Return Coefficient

  10. Bids originating from several Member States or submitted by a combination of firms • In the case of a supply contract, a bid is considered to come from a PB MS if at least 60% of the total amount of the bid originates from a PB MS • If this is not the case, the bid shall be treated as that of a firm offering goods from a WB MS

  11. Well balanced Member States For this invitation to tender, the following CERN Member States are WB MS for supply contracts: BG, CH, FR, HU, IT, PT

  17. Price Basis All prices shall be quoted in CHF or the preferred currency of the bidder: his national currency or the currency in which he will have major expenses, free of taxes, not subject to revision

  18. Payment milestones 10% of total amount of contract after signature of contract and receipt of bank guarantee 20% of total amount of each release order thirty days after approval of design file 70% of total amount of each release order thirty days after successful acceptance tests of supply

  19. Remuneration The first invoice shall be accompanied by a bank guarantee from a bank approved by CERN (BBB+ at least) of 10 % of total contractprice and valid untilend of warrantyperiodof last supplydelivered

  20. VAT • Prices shall take into account CERN’s exoneration from VAT and import duties • VAT shall be subject to the rules and invoicing instructions as defined under the following link: http://cern.ch/doc/vat.htmlOR http://cern.ch/doc/tva.html

  21. e-tendering instructions • In case you do not intend to submit a bid, please inform us, by using the button [Decline] in the CERN e-tendering application • If you have any problems or enquiries regarding the registration of your firm, the upload of your bid please consult the [FAQ] in the CERN e-tendering application or contactpurchasing.service@cern.ch • Bids shall in no event be sent by post, e-mail or fax • All documents comprising the bid have to be uploaded on the CERN e-tendering application by using the button [Submit Bid] in the CERN e-tendering application • The uploading may take time so we advise you to start at least one hour before the time limit

  22. Return Date Bids shall be RECEIVED by CERN on 14 September 2015, 4 P.M at the latest

  23. Law Applicableto Contractor’s Personnel

  24. Reminder According to its status CERN has the right to establish its own rules (i.e. SRR, safety rules, CPR) which are applicable to all HOWEVER: Contractors shall comply with common law as well as CERN rules

  25. Areas Concerned The other areas such as hiring, contract termination and personnel representation are not concerned by this new regime rest time & leave the minimum wage hygiene, safety and health at work protection for young workers and pregnant women or have just given birth equal treatment temporary work
