Activities to prepare the negotiations Several activities were decided upon, out of which six main milestones were maintained in order to prepare the negotiations of the VPA: • Official request to the European Union • Access to the laws • Definition of legality in Cameroon • Harmonization of the laws • Adaptation of the current strategy of control • Evaluation of the chain of custody and control systems in the field

  3. Official request to the European Union In October 2005 at behest of the Minister of Forestry and Wildlife, the Government of Cameroon made an official request to the EU Delegation so as to enter negotiations for a Voluntary Partnership Agreement (VPA).

  4. Access to the laws The first step to forest law enforcement is that all stakeholders get access to the legal instruments physically and in real time. ?

Access to the laws The Government of Cameroon has decided to become a full member of the Global Legal Information Network (www.glin.gov). • An assessment visit of the Official Gazette declared the ability of Cameroon of this Foundation . • We hope all the legal texts concerning FLEGT will be available on-line by the end of 2007.

  6. Definition of Legality Definition of Legality in Cameroon on the basis of: • The laws, • International agreements • Cohesion of all „Stakeholders“.

  7. Definition of Legality • A proposition of a grid containing : • principles, • Criteria • Indicators • References and • Means of control • has been elaborated with all stakeholders.

Definition of Legality This grid contains themes subdivided as follows: • Legal documents proving the existence of the company documents / General obligations • Fiscal obligations • Logging operations / Forestry and environmental obligations • Transportation of logs / Obligations related to the transportation of timber • Wood processing / Obligations of the timber industry • Social obligations

Harmonization of the laws Two fields of activities are to be undertaken in the medium term if FLEGT is to be a success in the long term: • The tidying up of the national laws • The harmonization of the laws with countries and organisations where there are legally binding agreements, for example: COMIFAC What law shall I use? They contradict one another!

  10. Chain of custody and control systems In order to be able to negotiate the government of Cameroon has elaborated the scale of the implementation of: • the control strategy and • the chain of custody from the tree to the harbour including the transformation process.

  11. Chain of custody and control systems The study comes up with a series of practical proposals including the running cost and investment costs for : • institutional organization, • capacity building and • equipments.

  12. Presently Cameroon is preparing the official request for the negotiations with the Prime Ministry, the Ministry of Finance and the Ministry of Commerce. • A grid and a timetable will be proposed to the EU. • The negotiations will be based on the different proposals already elaborated with the stakeholders in Cameroon. • Since this proposals are detailed and discussed with the NGO’s, different development partners, the private sector, the Government of Cameroon wishes to end the VPA negotiations in 2007 and to start its implementation in 2008.
