  3. WHAT DOES IT DO? • Eliminates eye sores and safety hazards • Saves thousands of dollars in landfill disposal costs • Saves valuable space in landfills • Reclaims and restores damaged land to use

  4. WHO IS ELIGIBLE? • ANY GOVERNMENTAL ENTITY • City • County • State • Federal • School • Tribe • Etc.

  5. WHAT IS IT? • A memorandum of agreement between the governmental entity and the DEQ to use suitable portions of the waste stream to reclaim and restore damaged land.

  6. SUITABLE WASTE • Material from dilapidated structures • Lumber • Shingles • Plaster/Sheetrock • Carpet • Brick, Metal, Rock • Glass • Etc.

  7. WHAT IS DAMAGED LAND? • Environmentally sensitive, non productive areas • Gullies • Washes • Abandoned Mining Pits • Old Silage Pits • Canyons

  8. IS THAT A TYPE OF LANDFILL? • NO • The land must be damaged and capable of being reclaimed for beneficial use • The accepted waste material is limited

  9. WHO ARE THE PRIMARY PARTNERS? • Governmental Entity (Applicant) • Department of Environmental Quality • Local Conservation District

  10. WHAT ARE THEIR ROLES? • Governmental Entity (Applicant) • Submit an application and necessary attachments • Comply with Memorandum of Agreement (MOA) • Contact DEQ regarding a project • Meet project deadlines

  12. ROLES CONTINUED • Local Conservation District • Provide a conservation plan which: • -Determines if site is located within a 100 year flood plain • -Determines if the site is within a known wetlands • -Provides recommendations for vegetative cover and erosion control

  16. APPLICATION CONTINUED • Description of solid waste to be used • Estimated volume in cubic yards • Origin of solid waste (address) • Required Attachments: • Deed for reclamation site • Legal access agreement if property not owned by entity (Form provided by DEQ)

  17. APPLICATION CONTINUED • National Emission Standards for Hazardous Air Pollutants , NESHAP, asbestos evaluations • Conservation Plan • Applicant’s signature

  18. APPLICATION SUBMITTAL • The application and all required documents are submitted through the reclamation specialist to the Land Protection staff attorney for review and routing through the approval process.

MEMORANDUM OF AGREEMENT • If the application is approved, a Memorandum of Agreement (MOA), which outline the conditions of the project, will be drafted. • The MOA will then be sent to the governmental entity to be signed by the authorized individual. • The conditions are outlined in the facts sheet under the heading, “FINE PRINT”.

  20. HOW LONG IS THE AGREEMENT VALID? • The site must be properly closed (covered with soil) no later than 120 days from the date the material is first placed at the site, or 15 days after the last load is delivered to the site, whichever comes first.
