Proposition 51 Basics • $9 billion total facilities funding • $2 billion for Community College Facilities • $7 Billion for K-12 School Facilities • $3 billion New Construction, $3 billion Modernization, $500 million Career Technical Education Facilities • Charter Facilities Funding • $500 million in funding reserved for Charters • Can be used for New Construction or Modernization (2) The amount of five hundred million dollars($500,000,000) shall be available for providing school facilities to charter schools pursuant to Article 12(commencing with Section 17078.52) of Chapter 12.5 of Part 10 of Division 1 of Title 1.
The politics of Prop. 51 • Placed on ballot without approval of the Governor or the Legislature • First School Facilities Bond to be done in this way • Sponsored initiative by Coalition for Adequate School Housing (“CASH”) and California Building Industry Association (“CBIA”) • Not supported by Charter Schools Association • Not supported by some major educational associations
Timing + Implementation • Short answer—we don’t know yet, but… • What we should be looking for is announcement of a first Charter funding round • Not before early 2017, and potentially further out • First signals will (should) be in the Governor’s budget • Second week in January 2017 • Look for Administration to signal any interest in program regulatory changes • Governor has been clear about need for changes to program • Look for signals regarding staffing up agencies responsible • Office of Public School Construction & California Dept. Education • Look for amount of bond debt service anticipated
Regulatory changes to Charter program • Prop. 51 funding is tied to the existing statutory framework • That said…there is room for changes to the regulations • For any of the programs under this bond • In the past this has happened through State Allocation Board Implementation Committee • On previous bonds Imp Committee meet and developed enabling regulations (b) The board may apportion funds to school districts for the purposes of this chapter, as it read on January 1, 2015, from funds transferred to the 2016 State School Facilities Fund from any source.
Looking ahead to meet State-funded Charter Facilities needs • Program regulation changes that could meet issues/concerns with current Charter program • Streamline program application process • Financial soundness re-reviews frequency • Reporting requirements made easier, simpler • Allow Charters access to funding immediately—not waiting for Priority in Funding • Changes to financial hardship program • Other needed program changes for Charters may need to wait for statutory changes
