Subsequently Commissioner, collaborator was permitted by the Commissioner Housing/ Registrar of Building Bye-Laws of Noida Authority and Fees of Rs.77 Lacs approx Noida who suggested after due veri?ication that the Architectural Plans for construction on this land shall be within the preview of Zilla Old Abadi already existed on above Land which was shown in Survey Panchayat. DM, ADM & SDM reports also clari?ies that Land comes reports under UPZALR Act of Section-143 of Land Zamindari. Society obtained permission to build Flats through a Developer / Zila Panchayat Sanctioned G+14 Storey Housing strictly as per the Meerut also con?irmed the same after disposing-off objections of Noida. Societies. was paid. Society had taken Clearances; structural safety certi?icate, NOC's from Various Departments i.e. Environment, Airport authority etc.

  12. Noida Authority entered into the footsteps of Zila Panchayat in 2015. Earlier Zila Panchayat was empowered by Govt. Order of UP bearing no. eclipsed from Gautambudh Nagar in 2015 only by the Govt. of UP. Hence the law of estoppels applies to the authority to honour the commitments of its predecessors. Noida Authority by its Order /Notice dated 23.09.2014 issued notice to The Ld. Court of Civil judge (Senior Division), Gautambudh Nagar Noida authority will not interfere in the peaceful possession, 15.10.2014 against Notice of Noida Authority for Demolition. 1045/23-2-210-96-98 dated 10.09.1998 under UP Kshetra Panchayat act 1961 under sub clause 2 of clause 239.   14. · Important to note the Noida Authority has given an affidavit before the Apex court in SLP no. 30969/2011 of Savitri Devi Vs Govt. of UP & Ors. that they do not acquire any land which falls Under Abadi. The Hon'ble Apex Court has recorded the statement of Noida Authority in Para no. 41 of its order dated 14.05.2015 as under:- “There is specific averment made by the NOIDA Authority at so many places that village abadi land was not acquired. It is men?oned that abadi area is what was found in the survey conducted prior to Sec?on 4 No?fica?on and not what is alleged or that which is far away from the dense village abadi”. “It has been the consistent stand of the NOIDA Authority that prior to the issuance of Sec?on 4 No?fica?on under the Land Acquisi?on Act, 1894, survey was conducted and the abadi found in that survey was not acquired. In fact, affidavits in this respect have also been filed not only in this Court but also in the High Court”. · Per?nent to men?on that if they cannot acquire this land as per the SLP and they cannot implement the plan on Abadi land as per NCR planning Board, we really fail to understand what purpose would it serve to demolish tall standing buildings and was?ng of all na?onal resources & wealth (Photographs enclosed).

  15. · Since Building Bye-Laws for Abadi also have been passed by Noida and are in existence since 2016 permi?ng six floors and the buildings were already constructed up to G+14 floors strictly as per the sanc?on map before the Abadi bye-laws. And therefore Sanc?on map for these buildings shall be regularized as a special case under Abadi bye-laws as these buildings have been constructed on the Abadi land and are as per the Noida Building Bye-Laws and no change is required in master plan / Zonal Development Plan of the sector. · A Project for 7 towers G+14 was approved by the Sanc?oning Authority out of which 280 flats belongs to the members (local farmers) of the society who themselves could not have built the house unless the rest flats were sold to other persons as per the collabora?on agreement with Developer executed a?er obtaining approvals of Commissioner Housing/ Registrar of Socie?es. The Society has already sold the Flats for which the Flat Buyers have raised loans from SBI, Na?onalized Banks & other Financial Ins?tu?ons. · A loan of Rs.21.6 Crores was also raised for development of the Society's works for speedy construc?on. All Banks did their legal due diligence & were sa?sfied for disbursing loans. Now lots of 3rd Party interests are exis?ng including Banks & Home seekers.

  16. · Apart from this it is important to men?on that the project is also UP-RERA registered under which the society / the Developer have to insure commi?ed deliveries to the home seekers as per RERA act. We the society of poor members who a?empted a be?er living are being harassed. The purpose of Noida Authority & Co opera?ve Socie?es in general as per Govt. of India Laws is to provide Shelter/ affordable Houses which is a commitment of Hon'ble Prime Minister and Hon'ble Chief Minister of the state. Since this case is having unique and peculiar/specific background and the Hon'ble High Court has also suggested the compromising method for regulariza?on of the buildings of the society would not form precedent for future cases. In view of the above, we request your good self to kindly regularize the buildings of the society under Abadai Niymavali of Noida & oblige.

  18. PRESENT STATUS: All the permissions / approvals for development of the Commercial Housing project such as architectural plans have been approved by the Zila Panchayat. The project is ready for construction. At present there is a loan against the project to the tune of Rs.24.60 Crore including up to date interest and the land consideration advance has been paid from own sources of the present promoters. The company has constructed 5 towers of 14 Floor each having 120 flats inventory at each block including site development work.
