  2. OHSA The Occupational Health and Safety Authority was established in 2000 by virtue of Act XXVII of 2000 (Cap 424)

  3. The Act shall apply to all workplaces, to all sectors of activity, both public and private… including schools Applicability of Act

  4. It is the duty of the Authority to : monitor compliance promote the dissemination of information promote education and training What are the duties of the OHSA?

  5. collate and analyse data carry out investigations promote and carry out research keep registers of persons competent to give advice….. Duties of OHSA

  6. Any “guilty” person is liable to imprisonment for a period of not more than 2 years or to a fine of not less than €466 but not exceeding €11.646, or both. The Court may also cancel all licenses, warrants or permits

  7. Main Causes of Legal Actions against Employers Failing to carry out a risk assessment Not certifying lift, cranes and boilers Not providing first aiders at the place of work No safety signs Providing poor health and safety standards on the workplace.   14. Who is responsible for maintaining the Health and Safety at the Place of work? (OHS)

  15. It is the duty of the EMPLOYER to ensure the health and safety at all times of all persons who may be affected by the work being carried out for such employer.

  16. Who is an Employer? Any person for whom work or service is performed by a worker or who has an employment relationship with a worker, and includes a Head of schools and Asst. Heads of School.

  17. Who is an Employer? In respect of all other organizations or in respect of any other form of employment under a contract of service, includes any of the persons in overall direction or having day to day management.

  18. Where an employer enlists outside services, this shall not discharge him from his responsibilities. Workers’ obligations in the field of OHS shall not affect the principle of the responsibility of the employer. IMPORTANT TO NOTE

  19. Duties of an employer Avoiding risk Identification of hazards Evaluation of unavoidable risks Control at source of unavoidable risks Reducing risks as much as reasonably practicable

  20. Duties of Employer Should safeguard the health and Safety of third parties. This includes but is not limited to: Students Visitors Contractors
