RA 9184:Government Procurement Reform Act of 2003 • State to promote ideals of good governance • Government procurements operate under the following principles: • Transparency in its process and implementation; • Competitiveness in public bidding; • Streamlined and standardized processes (mandatory e-procurement); • System of accountability (public and private parties); • Public monitoring through websites

  3. Functions of Bids and Awards Committees (BACs) • Advertise and/or post invitation to bid; • Conduct pre-procurement and pre-bid conferences; • Determine eligibility of prospective bidders; • Receive and evaluate bids; • Undertake post-qualification proceedings; • Recommend award of contracts; and • Prepare procurement monitoring report.

  4. Observers to BACs To enhance transparency of the process: • Representative of COA • At least two (2) other observers: • private group in a sector or discipline relevant to procurement at hand; and • non-government organization (NGO).

  5. Responsibilities of Observers • To prepare report indicating observations and assessment of BAC’s compliance to IRR; • To sign the abstract of bids if bidding activity followed correct procedure; and • To sign the post-qualification summary report if procedures are followed.

  6. Organizing Volunteers to PBACs • CAC thru BBC to organize a pool of private sector volunteers to be members or observers of the BACs. • Envisioned to help ensure credible and transparent government procurement. • Training shall be provided by Procurement Watch.

  7. Pre-bid Conference Bid Submission & Opening Post-qualification & Content Evaluation Awarding of Contract Bidding Process • Promotes fair competition and transparency in the bidding process • Opportunity for NGOs to inquire on unclear terms and expose irregularity, if necessary Advertisement

  8. CAC/BBC Objectives • Promote genuine transparency/accountability • Empower citizenry • Improve skills • Improve effectiveness of government procurement process

  9. Caveats • Ensure against ending up as “deodorizer” to BACs’ anomalous transactions; • There may be serious risks and threats to BACs volunteers (and their families);

  10. Proposals • Sign up to volunteer, preferably as institutions/organizations/corporations (sign up sheets available with roving assistants and with the desk) • Give paid time off to individuals assigned to actually train, sit and work as BACs members/observers

  11. Training and Preparation • Procurement Watch will conduct training for both prospective trainors and observers. • Training to begin in October, schedule to be advised.
