Project objectives • to develop a network for the exchange of information about national law among all the partners • to consider the impact of the proposal of regulation • to verify its scope of application • to study the recognition and enforcement of decisions • to analyze the implications of the proposal of regulation within the judicial system

  8. to identify and analyze a range of relevant questions and legal practitioners’ common needs • to analyze the system of circulation of decisions within the European judicial area • to critically examine the content of the proposal of regulation • to give advice on possible changes and/or integration

Project managementUniversity of Genoa OBJECTIVES to promote communication and cooperation between project participants (kick-off meeting in Italy) and to monitor project progress (implementation plan, interim and final report) • to coordinate the involvement of all partners • to provide technical, administrative and financial management • to elaborate all due plans and reports COORDINATOR’S TASKS PARTNERS’ TASKS • to coordinate their own activities in compliance with REMOR’s project • to report regularly to the coordinator • to attend project’s meetings and international workshop

Questionnaire to the Project Patners National law on maintenance/alimentary obligation (civil and private international law) What is the domestic legal “meaning” of maintenance / alimentary /assistance obligation? Which is the competent authority to apply? Who is entitled to receive maintenance and who is obliged to provide maintenance? Which are the criteria to determine the level of the obligation?

  22. Do the parties have freedom to fix the amount and/or to determine how or who have to pay maintenance? Is it possible to dispose of maintenance obligation (assignability, negotiability, leviablity, seizurability)? In which cases, according to the domestic law, the beneficiary may lose his right to maintenance? Which are the national rules about powers of assessment and enforcement of the obligation? Maintenance/alimentary obligation and problems of private international law (applicable law, competent judge, recognition and enforcement of the decisions).
