  1. LS308: Law and Society Unit 6 Seminar Unit 6 Discussion

  2. Unit 6 Discussion (1 of 4) Law and Social Change • The relationship between law and social change is an important dimension of the study of law and society. Social change can affect law (law as a dependent variable) and legal change can affect some aspect of society (law as an independent variable). Some issues involve law as both a dependent AND an independent variable. • In this unit we will discuss the views of prominent legal theorists who provided very historically important and still very influential work on the impact of social change on law. We’ll also discuss the relationship between law and social change.

  3. Unit 6 Discussion (2 of 4) Law and Social Change Unit Outcomes: • Analyze the impact of social change on laws (DQ, activity 2) • Analyze the impact of law on social change (activity 1, seminar) • Summarize how law is used by and against social movements

  4. Unit 6 Discussion (3 of 4) Law and Social Change Discussion Scenario: The 1954 United States Supreme Court decision in Oliver L. Brown et.al. v. the Board of Education of Topeka (KS) et.al. is among the most significant judicial turning points in the development of our country. Originally led by Charles H. Houston, and later Thurgood Marshall and a formidable legal team, it dismantled the legal basis for racial segregation in schools and other public facilities. Let’s discuss how this decision illustrates the difficulties in determining the effectiveness of law as an agent of social change http://brownvboard.org/summary/

  5. Unit 6 Discussion (4 of 4) Law and Social Change Extra! Extra! • In the introduction to this unit we conducted a review of same-sex marriage as an example of the interplay between law and social change. • Let’s review some current information on the subject, from the National Center for Lesbian Rights (NCLR) http://www.nclrights.org/site/PageServer?pagename=issue_marriage
