  3. 2018 Utah Legislation – Commercial Waste Fees • House Bill 169 – Commercial Waste Fee Amendments • Modifies fees paid by owner of commercial radioactive waste treatment or disposal facility: • Reduces the annual fee paid by the owner of a commercial radioactive waste treatment or disposal facility that receives radioactive waste. • Credits the amount of tax paid toward the flat fee and appropriates that amount from the General Fund. If the Legislature fails to appropriate adequate funds, the owner or operator pays the balance.

  4. 2018 Utah Legislation – Joint Resolution to Create Solid Waste Landfill • Senate Joint Resolution 11 – Authorizes EnergySolutions to create a landfill for non-radioactive waste • Grants provisional legislative approval for construction and operation of a Class VI (construction-demolition waste) commercial nonhazardous solid waste landfill: • Additional approvals required: • Tooele County • Division • Governor

  5. NRC Program Evaluation – Follow-up • December 12-14, 2017- Follow up to- • July 2015 full IMPEP • November 3, 2016 follow-up IMPEP • Found to be compatible. • Next full IMPEP will be July 2019.

EnergySolutions – Clive – LLRW LLRW DISPOSAL • Evaluation of Performance Assessments • Erwin ResinSolutions (SempraSafe) evaluation • EnergySolutions withdrew its request for approval • The Division is still evaluating how to proceed • Depleted Uranium • The Division and its contractor are evaluating EnergySolutions response to the last round of interrogatories.

EnergySolutions – Clive – LLRW LLRW DISPOSAL • License renewal – The Division is currently working on license conditions with the facility and is planning on having the license out for public comment within the next few months • Ongoing oversight / activities • Incoming shipments • Containerized waste – waste classification verifications • Waste management operations & site monitoring program • Final cover construction for a portion of LLRW Cell • Rehabilitating clay borrow pits

  9. EnergySolutions – Clive 11e.(2) Byproduct Disposal • 11e.(2) Byproduct Material • License renewed – November 30, 2017 • Groundwater Permit Amendments • The Division is reviewing EnergySolutions request for changes and is planning to respond soon.

  10. EnergySolutions – Clive Mixed Waste Disposal • Mixed Waste • Permit is still ready for renewal • Division is drafting a Research, Development and Demonstration (RD&D) Permit to resolve the treatment in the cell issue. • The Division will work with EPA for approval.
