  1. Leo Mongillo Law – The Advantages & Disadvantages of a Domestic Partnership

  2. Marriage is not for everybody. People believe in testing waters before getting married. Couples have to legally register their domestic partnership. The partners in a civil union enjoy some of the rights imparted only to married couples. Partners make a document of their own outlining the role and responsibility of each partner. The document states how money matters, assets, etc., will be dealt with during the relationship. The legal draft sometimes also defines the division of assets if the couple decides to part ways.

  3. Who can become Domestic Partners? • People who have reached the age of eighteen and are mentally healthy to enter into a contract • People who intend to stay partners indefinitely.  • Stay in the same house. • People who decided to be responsible for each other’s finances and health. • The partners are not married or in a domestic partnership with someone else. • People who are aware that any false documentation can lead to legal action. Providing wrong information or withholding information from the government is a punishable offense.

  4. Advantages of Domestic Partnership Not all governments legally accept domestic partnerships. People might not want to get married. Maybe they do not want to go through another violent marriage or do not want obligations that come with being married, etc. According to Leo Mongillo Law few other advantages are:

  5. The partner gets covered under each other’s health and insurance plans. • The partners are eligible for holidays to take care of a sick partner. • Married people have to file taxes together, which leads to a higher tax slab. Partners in a domestic partnership can save tax by filing taxes individually. • Some governments allow domestic partners to inherit properties after the death of a partner. • The partners are allowed to visit each other in jails and medical care facilities. • Sometimes partners are allowed to make medical and financial decisions on behalf of each other.

  6. Disadvantages of Domestic Partnerships When Compared to a Marriage The major downside is that not all governments recognize domestic partnerships. Some insurance, healthcare agencies, and foreign governments may create problems. • Filing taxes jointly can help married people save tax. Domestic partners are not allowed to file taxes jointly. • If a partner dies, the other cannot claim social benefits. • In a traditional marriage, the properties get inherited by the surviving partner automatically. It is not the case in a domestic partnership. The partner may write a will to transfer some properties to the surviving partner.

  7. If a company provides health benefits to non-employee partners, the amount is taxable. The coverage amount may also be different in the case of a domestic partnership. • The domestic partner does not enjoy all the benefits like a traditionally married spouse. They may not be allowed access to information. They might also not be allowed to make medical decisions for their partners.

  8. Domestic partnership and the laws that govern it are complicated. A family law firm like the Mongillo lawfirm can guide the partners. The lawyers can help draft the cohabitation agreement. If the partnership does not work, the lawyers can help with the division of assets, child custody, etc. SOURCE CREDIT: https://leomongillo.wordpress.com/2022/03/03/leo-mongillo-law-the-advantages-disadvantages-of-a-domestic-partnership/
