  1. Leo Mongillo — Different Rules About Parental Liability

  2. Parents are liable for the safety of their children. They are also responsible for the mistakes their children make. Some laws define the liability of the parents if their child gets involved in criminal activities. The law prescribes the age till which the parents can be held liable for the actions of their children. The parents can be served notices and subjected to lawsuits if their children commit crimes against people or property. The parents can reach out to their family lawyers to help them with parental liability laws. Different states have different rules about parental liability and Leo Mongillo have mentioned some of them are as follow:

  3. Lawsuits for Damage to Property The parents are liable if the child intentionally damages somebody’s property. The liability is a civil liability because it is not a criminal offense. Any damage to the property has to be compensated by the parents. Civil parental liability ensures that the parents take care of their children and supervise them. The civil liability of the parents ends when the child becomes a major. Sates have different rules regarding the maximum claimable amount. In some countries, the parents are liable to pay for damage even if the damage was unintentional. Anybody found negligent in the supervision of the child can be responsible. Parents, grandparents, people with custodial rights can also be liable for the child’s crime.

  4. The Parents have two points to present their defense in court: • If the parent can prove that the child was under proper supervision when the damage took place • If the parent proves that they tried to stop the child from doing the said damage. The law also states that the owner is liable for any damage caused using the family car irrespective of the person driving the car. If the owner consented to the use of the vehicle by the said person. The law believes that letting a minor drive was negligence on the part of the parent.

  5. Lawsuit for Criminal Activity No parents want their child to be a part of a crime. Any criminal offense done during childhood can cause problems when the child grows up. The past follows them into adulthood. Most states are against penalizing parents for the crimes of the child. Holding the parent liable for a child’s crime only leads to more disturbance within the family. The laws vary from state to state. The parents are responsible if the negligence by the parents is proved in court.

  6. Other Crimes The possession of firearms by a child is a punishable offense. Some states have criminalized leaving firearms near children. Parents are responsible if they do not keep their firearms out of reach of children. Cybercrimes committed by children are punishable. When parents and guardians find themselves stuck in a lawsuit concerning their children, they must reach out to a family attorney. The family attorney helps the parent navigate through the lawsuit and court hearings. Mongillo law firms are specialists in family law. Leonardo Mongillo is a certified collaborative lawyer who tries and solves family issues outside the court.
