The Basics…… • 100% Exam • 2 Units • 2 Papers • 2 Days • The AS is worth 50% of the overall A Level grade What skills will you need to be a successful law student? • The ability to write detailed essays • The ability to retain a lot of factual information • The ability to be punctual and equipped • The ability to meet deadlines • The ability to work independently

  3. What will we cover this year? • English Legal System We will follow the whole system through …… from the police to the conviction, sentencing and appeal. And learn what it will take to become a lawyer. 1 x 2 hour exam 4 questions – a mix of essay & problems • Sources of Law Basically, this will show you where we get laws from, how we make them and how we figure out what they mean. We will look at both how Parliament and how the Courts create law. 1 x 1 hour exam 1 complete question – a mix of essays & short problems

  4. The rules These are not the only rules, but they are the most important at the minute. We will leave the rest for you to discover at your leisure! • Get yourself a folder, pens, paper • Always bring your equipment to each lesson • Never miss a lesson • Always hand your work in on time (by email this means the day before it is due). • Never use, have out, or otherwise make your mobile phone visible in class • Remove all hats and outdoor clothing when in the classroom

  5. Resources • You do not need to buy lots of expensive textbooks • You will be provided with one core text, supplemented with handouts • Additionally, there is a good selection of textbooks within the library for you to read around the topics studied.

  9. Which is NOT a law? Melton Mowbray Pies can only be made in Melton Mowbray It is illegal to leave a sofa on the street It is illegal to sell a drunk person alcohol It is illegal to wear a suit of armour in Parliament It is illegal to fire a canon within 300 yards of a house If a man comes to your front door with coal, you must allow him to have a jug of milk It is illegal for a woman to eat chocolate on a bus You cannot buy ugly strawberries and tomatoes in the supermarket You can assault someone without touching them

Law, Morality & Justice • Are they all the same thing? • What do we mean by these words? • Can you think of something which is morally ‘bad’, but not illegal? • Can you think of something which might be both legally and morally wrong. Could you achieve justice? • When sentencing a criminal offender, what do you think the judge is focused on? Why?

What happens when the criminal justice system goes wrong? • What were the failures of the system? • What recommendations would you make to the criminal process (from the police through the courts) to ensure that this does not happen again? • Which do you think was the main focus of the judge at the first trial: justice, legality or morality? Why?

Interpreting the Law(it’s a new language) R v Bassett [2008] WLR (D) 157 Charge: Voyeurism of a man under s.68(1)(a) Sexual offences Act 2003 In order to be liable for the offence, the victim had to be taking part in a ‘private act’. E.g. exposing breasts by undressing Facts: The defendant (D) concealed a camera in his bag to spy on other men in the changing rooms at the swimming pool. He spied on a man who was wearing his trunks in the shower and washing his 3 year old daughter’s hair. Problem: Are male breasts covered by the act?

Finally….The Christmas Act 2012 This is an act to encourage the celebration of Christmas as a national holiday and time of charity This Act provided that: • Christmas shall always fall on the same date every year • Each adult will be entitled to free food on Christmas • Every household shall buy a tree • Every household shall display a wreath at the entrance to their house. • All deer shall be given a red nose for the occasion What problems can you spot with the wording of this Act?

  14. HOMEWORK • Tony Nicklinson died six days after losing his ‘right to die’ case. • He suffered from Locked-in syndrome and the verdict left him totally devastated. • Your task is to research Mr. Nicklinson’s case and write an essay outlining the facts and outcome of the case as well as commenting as to whether or not the judge was correct in his verdict.
