  2. Urban regulation Territorial / urban / land regulation: • One of the most intrusive functions of the state • Strong reasons why it exists – what are those? • Shared between central (C) / intermediary (CJ) / local governments (CL), with many cross-cutting links

Hierarchy of plans / regulations • Plan for Territorial Management (Plan Amenajare Teritoriu, PAT) • County / Municipality (urban & rural): General Land Use Plan (Plan de Urbanism General, PUG) for the entire territorial-administrative area • Zoning Land Use Plan (Plan de Urbanism Zonal, PUZ) referring to a set of parcels of land • Detailed Land Used Plan (Plan de Urbanism de Detaliu, PUD), a detailed clarification of planned projects in specific areas

Hierarchy of plans / regulations When private agents want to build / change the land destination, they must: • Ask for information on existing regulations (PUG / PUZ / PUD) – explained by the authority in a Certificat de Urbanism (CU) • Prepare a Project (P) and get all the permits listed in CU • Submit P for approval (authority checks compliance) and get Building Permit (BP)

Urban regulation – tools PUG / PUZ / PUD impose various constraints on a piece of land (private owner) – ex: • POT (procent de ocupare teren) = fraction of footprint from total plot • CUT (coeficient de ocupare teren) = fraction of unfolded area of the building from total plot • Maximum height • Withdrawals (from plot’s edges)

  6. Urban regulation – tools Constraints – ex: • Materials used (texture and colors) • Shape and style of building, including roofs • Amount of green space, as % of the plot • Min (max) number of car parking places • Type of activities on the plot (residential, commerce&offices, industry, etc) • Special protection regime (heritage building, protected area, etc)
