  4. 例一：『年幼無知』 • 例二：『我又不是故意的』 • 說明－ • 在法律上並無法因為「無知」或是「非故意」而不用負擔責任！ 不知者不罪

  5. 過失：依刑法§14分為 • （1）有認識之過失 • （2）無認識之過失 ＊以上情形，仍應負刑事責任，接受法律的處罰。 過 失

  6. 刑法之規定： （1）滿十八歲以上，係刑法上之成年，需負完全的刑事責任 （2）十四歲以上未滿十八歲，得減輕其刑。 （3）未滿十四歲，不罰。 年齡和日常法律行為效力之關係
