8. 1997 Eight-Hour Ozone Standard • Standard is 0.08 parts per million (ppm) • Design values of 84 parts per billion (ppb) or less are attainment • Houston-Galveston-Brazoria (HGB) Area • Brazoria, Chambers, Fort Bend, Galveston, Harris, Liberty, Montgomery, and Waller Counties • Dallas-Fort Worth (DFW) Area • Collin, Dallas, Denton, Ellis, Johnson, Kaufman, Parker, Rockwall, and Tarrant Counties

9. 2008 Eight-Hour Ozone Standard • In 2008, Environmental Protection Agency (EPA) strengthened eight-hour ozone NAAQS from 0.08 ppm to 0.075 ppm • EPA finalized designations May 21, 2012 • First portion of implementation rules published February 14, 2012 • Final guidance released - “Ozone Advance”

12. HGB Area • SIP revision to update Motor Vehicle Emission Budgets (MVEB) adopted April 23, 2013 • For the 1997 eight-hour ozone standard • Applies to attainment demonstration and RFP budgets • Necessary for transportation conformity purposes

13. DFW Area • Reclassified serious nonattainment for 1997 ozone standard effective January 19, 2011 • Attainment deadline no later than June 2013 • Attainment Demonstration and RFP SIP revisions adopted December 2011 • Designated moderate ozone nonattainment area for the 2008 standard • Wise County added to nonattainment area • Attainment deadline December 31, 2018 • Attainment Demonstration due July 20, 2015

Beaumont-Port Arthur (BPA) Area • Attainment (maintenance) for the 1997 standard • Redesignation request and maintenance plan approved by EPA on November 19, 2010 • SIP revision to update MVEB adopted November 14, 2012 • Applies to 2021 maintenance budgets • MVEB SIP approved by EPA on March 6, 2013 • Designated attainment/unclassifiable for the 2008 standard

22. 2010 SO2 NAAQS • In 2010, EPA revised SO2 NAAQS by establishing a new one-hour standard at 75 ppb • EPA proposed nonattainment designations in July 2013 • Proposed designations based on current monitoring network only • All areas of Texas attaining the standard based on current regulatory monitoring network • Infrastructure and transport SIPs adopted April 23, 2013

29. 2010 NO2 NAAQS • In 2010, EPA strengthened NO2 NAAQS by establishing a new one-hour standard at 100 ppb • New monitoring network requirements • One NO2 monitor in HGB, DFW, Austin, and San Antonio areas to be collocated at near-road monitoring station by January 1, 2014 • A second NO2 monitor required in HGB and DFW areas by January 1, 2015 • One NO2 monitor in El Paso and Edinburg-Mission-McAllen areas to be collocated at near-road monitoring station by January 1, 2017

30. 2010 NO2 NAAQS • Initial designations published February 2012 • All areas of the U.S. unclassifiable/attainment • EPA to redesignate areas when three years of data collected from new monitors (likely 2017-2018 time frame) • Infrastructure and Transport SIP adopted in November 2012

33. Cross State Air Pollution Rule(CSAPR)

34. CSAPR • Final rule published August 2011 • Intended to replace the Clean Air Interstate Rule (CAIR) • Addressed 1997 ozone and PM2.5 and 2006 PM2.5 NAAQS • Required 28 states to reduce power plant emissions that cross state lines

35. CSAPR Litigation • December 2011 – U.S. Court of Appeals for the D.C. Circuit stayed the rule • August 2012 • D.C. Circuit vacated CSAPR • Ordered CAIR to remain in place until replacement rule is in place • January 2013 – subsequent request for rehearing denied • On June 24, 2013, Supreme Court granted EPA’s petition to review D.C. Circuit’s decision

36. Future of Interstate Transport • Currently awaiting guidance from EPA on how to proceed with reliance on CAIR • TCEQ has continued to issue CAIR allowances verbally • Meetings scheduled with states in April 2013 to discuss the path forward to address interstate transport • States encouraged to actively participate

37. Regional Haze

38. Regional Haze • Rule requires states to improve visibility in 156 national parks and wilderness areas • Big Bend National Park • Guadalupe Mountains National Park • TCEQ’s Regional Haze SIP revision submitted to EPA in March 2009 • Consent decree states that EPA propose evaluation of Regional Haze SIP revision in May 2014 and make final determination by November 2014

39. Regional Haze • Five-year Regional Haze Progress Report due to EPA in March 2014 • Progress Report proposed June 18, 2013 and scheduled for adoption February 12, 2014
