  2. What is a hazardous materials incident? IC 39-7103(3) “An emergency release of a hazardous substance that requires a response from the Regional Response Team or the Local Emergency Response Authority”

  3. EVERY INCIDENT IS UNIQUE

  4. Who makes the rules? • IC39-7104(3) “The military division shall promulgate rules and procedures which shall govern reimbursement of claims pursuant to this chapter.”

  5. Who pays for it? • IC39-7102 “State has a duty to protect the citizens and environment of Idaho…” • IC39-7111 “Spiller is strictly liable for costs except for acts of God, war, or third parties.” • Taxpayers

What is covered? • IC 39-7109 lists what can be claimed for reimbursement • IC 39-7109(3) “Claims shall be submitted to military division within 60 days of incident termination” • IC 39-7110(1) “Military division shall make recommendations to the board of examiners within 120 days of incident termination” • Reasonable and prudent

  8. What is not covered? • IC 39-7110(1) Costs of routine firefighting shall not be reimbursable • Excessive meal costs • ( Use State guidelines for expenses) • Breakfast = $7.50 • Lunch = $10.50 • Dinner = $16.50 • Excessive apparatus costs • ( Use Department of Lands Guidelines) • Type 1 = $104/hr • Type 2 = $ 86/hr • Type 3 = $ 52/hr
