  3. INTRODUCTION The Office of the Chief Justice (OCJ) held a 2-day Strategic Planning Session on the 15th and 16th May 2014. During the planning session the following were achieved: 1st Drafts Strategic Plan (2015-2020) & APP (2015/16) were developed in line with the new Framework for Strategic Plans and Annual Performance Plans as prescribed by the National Treasury and were submitted to NT, AG & Department of Performance Monitoring & Evaluation. {End August 2014} 2nd Drafts Strategic Plan (2015-2020) & APP (2015/16) were also submitted to the NT, AG & Department of Performance Monitoring & Evaluation for approval. {End November 2014} N.B The two Strategic documents were developed internally; without involving service providers/ consultants.

MANDATES (Continues…) The mandate of the Office of the Chief Justice (OCJ) is to support the Chief Justice in executing administrative and judicial powers and duties as Head of the Judiciary and Head of the Constitutional Court. Functions: To provide and coordinate legal and administrative support to the Chief Justice; To provide communication and relationship management services and inter-governmental and international coordination; To develop courts administration policy, norms and standards; To support the development of Judicial policy, norms and standards; To support the Judicial function of the Superior Courts; To support the Judicial Service Commission in the execution of its mandate; To support South African Judicial Education Institute in the execution of its mandate; and To administer Judges’ Remuneration and Conditions of Employment Act

COMPLIANCE National Treasury approved the budget programme structure on the 12 April 2013, which covers the Superior courts, SAJEI and Judges Salaries as direct charge from the National Revenue Fund; All the National Treasury requirements were complied with (NT framework for Strategic Plans and Annual Performance Plans); The Budget Vote for the OCJ (Vote 22) has been created; SG is the the Accounting Officer for OCJ; and Audit & Risk Committee Appointed in May 2014

STRATEGIC PLAN AND APP Over the MTSF period, the OCJ will ensure effective implementation of the Superior Courts Act, 2013 and the Constitution 17th Amendment Act, 2012 and align its plans towards the realisation of the objectives of the NDP. The three Strategic Goals of the OCJ are as follows:

  10. STRATEGIC PLAN AND APP (Continues…) Chapter 14 of the National Development Plan stipulates four focus areas for strengthening judicial governance and the rule of law. The following are the key focus areas: Judicial selection and appointment, and judicial ethics , the leadership and management of the judiciary, and the administration of the courts. Training of Judicial Officers Access to justice and speedier resolution of court cases Accelerate reforms to implement a judiciary-led independent court administration

  17. PROGRAMME 1: ADMINISTRATION Purpose Provide strategic leadership, management and support services to the department. Description The programme consists of the following sub-programmes: Management provides administrative, planning, monitoring, evaluation and reporting functions necessary to ensure effective functioning of the Department. Corporate Servicesprovides an integrated Human Resources Management (HRM), Information & Communication Technology, Security Management and Communication support services to the Judiciary and the department. Finance Administration provides overall financial, asset and supply chain management services to the Judiciary and the department. Internal Audit and Risk Management provides overall internal audit and risk management services to the department and the superior courts. Office Accommodation provides foracquisition of office accommodation for the department.

PROGRAMME 2: JUDICIAL SUPPORT AND COURT ADMIN Purpose Provide judicial support and court administration services to the superior courts, including secretariat and administrative support services to the Judicial Service Commission. Description The programme consists of the following sub-programmes: Administration of Superior Courts provides administrative and technical support to the Superior Courts, monitor the overall performance of the Superior Courts, and enhance judicial stakeholder relations. Judicial Service Commission provides secretariat and administrative support services to the Judicial Service Commission to effectively perform their constitutional and legislative mandates. Constitutional Court adjudicates on constitutional matters and any other matter that is of general public importance.

PROGRAMME 2: JUDICIAL SUPPORT AND COURT ADMIN (Continues…) Supreme Court of Appeal adjudicates appeals in any matters arising from the High Court of South Africa or a court of a status similar to the High Court. High Courts adjudicate and provide resolutions on criminal and civil disputes and hear any appeals from the lower courts. Specialised Courts adjudicate over various types of matters excluded from the jurisdiction of the Divisions of High Courts and Magistrate Courts. These include adjudication on labour, land, electoral and competition matters.

PROGRAMME 3: JUDICIAL EDUCATION AND RESEARCH Purpose Provides education programmes to judicial officers, including policy development and research services for the optimal administration of justice. Description The programme consists of the following sub-programmes: South African Judicial Education Institute (SAJEI) provides continuing judicial education for Judicial Officers and training of aspirant Judicial Officers. Judicial Policy and Research provides advisory opinions on policy development, research and regulatory support services to enhance the functioning of the Judiciary.

  33. Sub-programme 1: South African Judicial Education Institute NB: The envisaged date of appointment of 157 District Court Magistrates according to Magistrates Commission is 1st Feb 2016. SAJEI will not have sufficient funds to train all the newly appointed magistrates.

  35. KEY RISKS ASSOCIATED WITH THE STRATEGIC PLAN

  36. CONCLUSION The OCJ SP and APP still unfunded to the amount of R75,765 million for the 2015/16 financial year. We ask the Portfolio Committee to assist us to negotiate with the National Treasury to allocate funds for all unfunded mandates. The OCJ Strategic Plan and APP are aligned with the National Treasury’s Framework for Strategic Plans and Annual Performance Plans. Both the two strategic documents are also aligned to the MTSF, NDP and focus on service delivery.

  37. CONCLUSION (Continues…) The objectives will be applicable for the next 5 years and evaluation thereof will only be done at the end of the MTSF. There are clear linkages between the plans and government outcomes / priorities. For instance; Programme 1 (Administration) is linked to Outcome 12 (An efficient, effective development orientated public service); Programme 2 (Judicial Support and Court Administration) is linked to Chapter 14 of the NDP Vision 2030: Strengthen judicial governance and the rule of law; and Programme 3 (Judicial Education & Research) is also linked to Chapter 14 of the NDP Vision 2030: Strengthen judicial governance and the rule of law.
