  1. Importance of Appellate Tribunal Appellate Tribunal was constituted to hear the court appeals against the ruling authority and the authorities under the same act. With the advancement of tribunals in many countries with the new adding of Appellate Tribunal, the work of ITAT or the income tax has become more efficient to establish other rules. In this article, we will know about the importance of the Appellate Tribunal and its court. The differences between Appellate Courts and trial courts: At the trial courts in the USA, the witnesses give the testimony and the jury and the judge decide if the charged person is guilty or not. In India, the system is quite the same and at last, the judge imparts his decision. The court system does not testify to the witness. However, in the case of Appellate courts, there is no jury to give their opinions. This court reviews the process and the decisions of the trial court to ensure that casework becomes fair and the exact law is applied. The right to appeal: Here an appeal is available if after the trial court is losing the case and is facing issues with the proceedings and the law was applied. Normally, based on these, litigants are capable of raising an appeal to the appellate court and reviewing the actions of the trial court. When it’s a criminal case the government will not be able to appeal. The base of appealing: The grounds for the appeal will vary. However, the most common reason is the unsatisfactory side claims that the trial court couldn’t conclude properly. The judge may have applied a wrong law, or the rule was applied wrongfully. The dissatisfied party can also claim that the law of the trial court violates the other rules of the constitution.

  2. Before attorneys of NCLT Delhi come to court to fight for their appeal, each party submits a written document which is known as a brief. This can be a long document, and here the advocates describe the case for the jury and the judge before starting the arguments at the court.
