  1. Investigation Survey of Private Sector for OSHE in Zhejiang Province CHEN Qin’an Zhejiang Provincial Federation of Trade Unions in China 20 July 2006

Background and Justification • 1.1 Since China’s reform and opening-up began, the country’s private sector has rapidly developed. • 1.2 In some private enterprises, the working condition is poor. At the same time, some workers lack of personal protection equipment. Some of them lack of occupational education.

  3. 1.3 Although the OSHE has improved in the private sector, the situation of safety is not optimism. • 1.4 The report system on work-related accident and disease is not integrity. • 1.5 China Trade Unions has paid attention on those problems of OSHE in the private sector.

  4. 1.6 The Safe Production Law of the People’s Republic of China prescribes: • Production operation units shall possess production safety conditions as required by the Law, other relevant laws and administrative regulations, as well as national standards or trade standards. Whoever fails to provide safety conditions shall not engage in production operation.

  5. 1.7 The Trade Union Law of the People’s Republic of China prescribes: • Trade unions shall have the right to investigate into the infringements upon the legitimate rights and interests of the workers and staff members by enterprises or institutions, and the units concerned shall give them assistance.

  6. Trade unions shall participate in investigation into and settlement of job-related accidents causing death or injuries to workers and staff members and in investigation into and solution of other problems seriously endangering the health of workers and staff members. • Trade unions shall make proposals for solutions to the departments concerned, and have the right to demand that the persons who are directly in charge and the other persons who are responsible be investigated for their liabilities. The proposals put forth by trade unions shall be considered and replies be given without delay.

  8. (2) Implementers: • Labour Protection Department of Zhejiang Provincial Federation of Trade Unions in China.

  9. Development Objectives This work-plan will contribute to achieving the following: • Offer basis information for tripartite bargaining. • Improving workers’ working conditions in the private sector.

  10. Immediate Objectives • (1) Immediate Objective 1 • Get data basic information of OSHE in the private sector in Zhejiang Province. • (2) Immediate Objective 2 • Accomplish reports of OSHE.

  11. Key Outputs/Direct Results • 6.1 11 municipal cities are investigated in Zhejiang Province. • 6.2 Visiting the regional government and trade unions to investigate the basic circumstance and problem. • 6.3 Investigating private enterprises. • 6.4 Designing enterprises’ investigation forms. choosing 50 enterprises to fill the investigation forms in each municipal city.

  12. 6.5 Designing workers’ investigation forms, random choosing 1000 workers to fill the investigation forms in each municipal city. • 6.6 Analysing the data basic information, accomplishing reports of private sector for OSHE. • 6.7 Urging and supervising the government to implement the regulations concerned on the problems of OSHE in private sector.

  14. Indicators of Achievement • (1) For Immediate Objective 1 • Comprehend the situation of OSHE in the private sector. • (2) For Immediate Objective 2 • Make a final report to Zhejiang Province Government. • Government take measures for OSHE in the private sector.

  15. Monitoring, Reporting and Evaluation • (1) The Labour Department will give report on the situation of OSHE to the Secretariat of the ZJPFTU every month. • (2) The Secretariat will report to the Presidium of the Zhejiang Congress of Trade Unions every three months. • (3) The Presidium will report the whole year’s work to the Executive Committee of the Zhejiang Congress of Trade Unions. • (4) The Executive Committee will make a final report to Zhejiang Province Government.
