The Healthy Lawns and Clean Water Initiative • MOU between Executive Council and major lawn care product companies to reduce opportunities for nutrient losses from “Do it Yourself” lawn care product use • 75% of lawns receiving fertilizer are DIY • MOU covers all of each Bay state and product changes will become national • Education is important part of agreement

Lawn Fertilizer and Phosphorus • Grass needs limited P after establishment • Substantial P needed at establishment • Research indicates most P loss from lawn fertilizer use is from misapplication or application to drives, sidewalks and curbs • Can reduce P in lawn fertilizer w/o impacting turf quality • “If you don’t use it, you can’t lose it”

Background • B4B and Land Grant University (LGU) Regional Water Quality Program involved in National “Lawns and the Environment” discussions; consensus not reached • Rich Martinez, Chief Environmental Officer for Scotts Miracle Gro met with NSC and LGUs in early 2005 • Late 2005, Mid Potomac Tributary Team hosts “From Your Backyard to the Bay” and involves industry • March, 2006, Martinez meets with NSC, LGUs and state reps to discuss possible P reductions • Spring, 2006, concept draft of MOU developed and endorsed by NSC, IC and PSC for further development • Detailed negotiations and refinement of MOU continue with agreement on proposed content on July 26, 2006 • August, 2006, being presented to PSC and CEOs for expected endorsement and final agreement

Why did we get here? • S-MG established Chief Environmental Officer and wanted to strengthen environmental emphasis (and is leading RISE efforts) • B4B, LGU Regional Water Program, Trib Teams and CBP were already engaged and responsive • Industry concerned about local and state laws or ordinances requiring no P or different P labels • Industry views as opportunity to be environmentally responsible and provide model for uniform approach to addressing water quality concerns

The Healthy Lawns and Clean Water Initiative(as proposed) • Reduce phosphorus in DIY lawn care products sold/applied in Bay states by 50% from a 2005 base by 2009 • Industry will report amounts sold by state on an annual basis • Convene group led by NSC for CBP, LGUs, and industry to recommend changes to N formulation, rates or application methods/timing to achieve substantial reductions in N losses from DIY product use • Recommend changes to N by September, 2007 for EC/industry adoption at 2007 EC

The Healthy Lawns and Clean Water Initiative(as proposed) • Develop comparable recommendations/ agreement regarding pesticide use and IPM not later than September 2008. • CBP and Industry develop, in cooperation with jurisdiction LGUs, consumer messaging and education about best application and management practices for use of lawn care products, such as mass media campaigns and point of sale consumer education programs at major retailers.

The Healthy Lawns and Clean Water Initiative(as proposed) • Use MOU, along with Urban NM and SWM as CBP’s primary nutrient reduction tools for homeowner DIY fertilizer use • Continue to work together for further reduction opportunities • Use this agreement/cooperation as model for other industry sectors

Expected Industry Partners on MOU(Represent more than 80% of market share) • Scotts Miracle Gro Company • Lesco (many store and specialty brands) • Spectrum Brands (Vigoro for Home Depot and StaGreen for Lowe's) • Lebanon-Seabord (Preen and Lebanon fertilizer) • Bayer • Howard-Johnsons • Bonide

  10. Requested PSC Actions • Endorse and get your Principal’s support • Convert to “legalese” but minimize changes made to wording and substance • Make this a major press event for CBP • Recognize SMG for their proactive leadership • Celebrate CBP’s leadership on this national issue
