REVISION OF THE EU DIRECTIVE 2000/59 • MEETING BRUSSELS 06TH FEBRUARY 2014. • Present: Laurent Prat DG Transport, Ana Bobo Remijn DG Transport, Benoit Loicq (ECSA), Michail Antonis (ESPO) Peter van den Dries (OVAM, Euroshore • New civil servant for the revision is ms Ana BoboRemijn. She has worked for DG Environment, ECOSOC, EMSA and now for DG Mobility & Transport.

EU DIRECTIVE 2000/59 • New study will be launched focusing on 2 items the fee system (as foreseen in the Directive itself art 8 §4) and the overall evaluation of the Directive (art 17). • Study will use as much as possible existing studies. Should be delivered end August 2014. An evaluation report will be available by September. • Afterwards an impact study will be finalised.

  11. EU DIRECTIVE 2000/59 • CONTENT: The revised Directive will take care of the changes of annex V of MARPOL (cargo residues…) • New types of waste will not be tackled in the Directive. Maybe that cross references will be made to other legislation. • Ballast water= IMO Convention NOT included in MARPOL, has to be tackled in national legislation (transposition of the IMO Convention)

EU DIRECTIVE 2000/59 • Scrubbers and (SCR) selective catalytic reactions are part of the alternative fuels (LNG, ethanol and methanol) and low sulphur fuels and as such covered by the Sulphur Directive (2012/33/EU). Which means that it will be covered by national legislation. This can cause differences in approach and in accepting certain technology. • Ship recycling is also a separate piece of legislation.

  13. EU DIRECTIVE 2000/59 • In order to harmonize the Directive, three guidelines will be published (which are already worked out by EMSA, but need a legal and policy check). • Waste reception and handling plans (art 6-7) • Exemptions for regular and frequent callers • Sufficient storage capacity

EU-DIRECTIVE 2000/59 • -To bring the Directive in line with MARPOL Annex 5 (cargo residues) and the notification could take another 3 years to go through the process. • -An alternative is the Comitology procedure. Comitology in the EU refers to a process by which EU law is modified or adjusted and takes place within "comitology committees" chaired by the European Commission.Comitology committees are part of the EU's broader system of committees that assist in the making, adoption, and implementation of EU laws.[ It has been substantially amended through Artt. 290 and 291 TFEU and, subsequently, Regulation (EU) 182/2011.

ESSF-GOALS • The European Sustainable Shipping Forum (ESSF) will advance the Sustainable Waterborne Transport Toolbox's efforts for a cost-efficient and coherent implementation of the provisions of the Directive 2012/33/EU  as regards the sulphur content of marine fuels which transposes the international low sulphur standards into EU law. • The ESSF will bring together Member States and maritime industry stakeholders. It will enable a structural dialogue, exchange of best practices and coordination, thus providing the opportunity to discuss practical issues that could be encountered during the implementation process, in particular during the transition phase before the entry into force of the new standard.
