  1. THE INS AND OUTS OF SMALL CLAIMS COURT IN CALIFORNIA

  2. There are two main types of court cases, small claims and civil court cases. Small claims court is designed to deal with civil cases involving monetary judgments of (though in some states, that amount may be higher). If you want to file a claim in small claims court, you’ll need to know where it’s located in your area, what forms you need to fill out and how much filing fees cost depending on whether you file online or in person.

  3. 1: WHAT IS SMALL CLAIMS COURT?

  4. Small Claims Court is a division of the Superior Court that deals with civil cases. These cases can include contract disputes, property damage, unpaid debts, libel or slander, and personal injury. The plaintiff (the person who filed the lawsuit) can represent himself or herself at trial without a lawyer but may want to consult an attorney for advice. The defendant (person being sued) has to be notified by mail that they have been sued.

  5. If they don’t respond within many days, they will automatically lose by default. The person filing the suit cannot ask for more than this amount unless it’s related to child custody, child support, landlord/tenant rights, or damages caused by public entities like state agencies. What happens if you win? A judgment order is issued telling the defendant how much they owe the plaintiff and when they must pay it back. If this order isn’t followed then additional fines are usually imposed on top of what was originally owed as punishment.

  6. 2: HOW DO I FILE A CLAIM?

  7. Small Claims Court is a place where disputes are handled quickly, inexpensively, and informally. To start the process, you need to file a Notice of Claim with the small claims clerk at the small claims court where you want to sue. Once your claim is filed, both parties will receive a copy of it. You can also use an Online Small Claims Filing Service for help with filing your notice of claim. There are no filing fees to use these services, which makes this option particularly cost- effective. These companies offer services such as automatic notification by email when your case has been filed; document templates that provide step-by-step instructions on how to complete forms; and secure payment options so you don’t have to pay up front and risk having no money if you lose the case or settle.

  8. 3: HOW MUCH DOES IT COST TO FILE A CLAIM?

  9. Small claims courts are meant for people who want to file a personal injury claim with a value of less Small claims cases can also be filed for property damage or unpaid debt. Each state has different rules about what types of cases can be filed in small claims court, so you will need to check your local laws. Once you have filed your case, both parties will have to go through mediation before they go to trial unless the defendant agrees beforehand that they want the case heard by a judge without mediation. If there is no agreement about how the case should be handled, then it will go through mediation first.

  10. 4: WHAT ARE THE DEADLINES FOR FILING A CLAIM?

  11. Claims can be filed by an individual or by a corporation. Filing a claim with the small claims court is not expensive, but it does require that you have some money to pay for the filing fee. Claims must be filed within many years from the date when the injury happened or from when you should reasonably have known about it. This means if you are injured on someone else’s property, you need to file your claim within many years of leaving the property or finding out about your injury.

  12. 5: HOW DO I SERVE THE OTHER PARTY? When you have the other party’s address, use one of two methods to serve them. The first is by using certified mail, which requires a signature from the person who receives it. The second is through a process server, who will hand deliver your papers to the other party. If you can’t find an address for the other party: If you know where they work or where they attend school, contact their workplace or school and ask if someone there could make sure that they get served. You may also be able to look up their address on social media.

  13. 6: HOW DO I PREPARE FOR MY HEARING?

  14. When you go to small claims court, there are a few things you need to know before your hearing. First, you will need to know the name and address of the person or company that you want to sue. You also need to bring evidence with you when you go to your hearing. This could be photos, receipts, or anything else that shows that they owe money or did something wrong. Finally, make sure that no one besides the judge knows the details of your case. Please contact us for more information about small claims court in California.
