How To File a Patent for Your Idea

patents are an important part of business today because they provide a legal right to the patent owner that protects their invention from being copied by others. In order to file a patent, you must first have an idea for your invention and then as the inventor, you need to write up a description of what your idea is so that it can be protected.

  1. PATENT IDEA How To File a Patent for Your Idea

  2. What we'll discuss TOPIC OUTLINE Whether you have an invention of your own or know someone who does, patents are a hot topic. But where do you start with the patent process? There’s a lot more to it than just applying for a patent and waiting for it to be approved or denied. In fact, there’s a lot of research involved in determining whether you need to file for a patent at all. For some insight into how to file a patent, see this PDF

  3. Why patent your idea? If you have a great idea and want to protect it, one of the ways to do so is by filing a patent. A patent application gives you the exclusive right to develop and market your invention to the public for a limited period of time. In the United States, a patent is good for 20 years from the date you file.During that time, other companies are free to use and sell the patent as they see fit.

  4. How to decide whether to patent your idea The first thing you should do when deciding whether to patent your idea is to know if your idea is patentable. You can do some research on whether ideas similar to yours have been patented before, or whether your idea is novel enough that you can get a patent.Check out patent.google.com or search the USPTO website for information about which types of inventions have been granted patents. If you do need a patent, seeking legal advice is also a good idea.

  5. How much does it cost to file for a patent? The cost to file a patent depends on a number of factors, including how complex your invention is, how long it will take to prepare the application, and how many claims you will have. In most cases, you should expect to pay between $7,000 and $8,000 to file for a patent. It’s also worth noting that a lot of the expense associated with filing a patent applies not only to the actual filing but also to the time around the filing. Patent filings and the preparation involved in winning a patent are known as promotion, and can range from a few days to several months. Traditional business models estimate the cost for this type of activity in the range of $10,000-$20,000+, while others go as high as $90,000+.
