  2. What is Notice of Ability To Return To Work?

  3. “Notice of Ability to Return to Work.” is the notice served to the injured worker or employee, according to Section 306(b)(3) of the Pennsylvania Workers’ Compensation Act when an insurer is in possession of medical evidence indicating that the worker is able to return to work.

  4. It is a notice though, injured workers don't necessarily need to return to work if they don't feel capable.

  5. What if you disagree with the Notice?

If you do not agree with the Notice of Ability To Return To Work based on your medical condition or if your situation contradicts with the medical information provided by the insurance company or employer's doctors, it is best to discuss it with your own doctor first. And then call in your workers' compensation lawyer to file evidence and dispute the allegations and information provided in the notice.
