  3. FAA 2010 AIP Program Why Another Split Year? 2 Things Needed to Operate Authorization X + Appropriation 

FAA 2010 AIP Program FAA FY 2010 Authorization X Continuing Resolution (Again and Again) • “Fiscal Year 2010 Federal Aviation Administration Extension Act Part I” signed September 2009 • October 1, 2009 to December 31, 2009 • “Fiscal Year 2010 Federal Aviation Administration Extension Act Part II” signed December 16, 2009 • Public Law 111-116 • Authorizes the AIP from January 1 to March 31, 2010 • Requires Calculation of Available Funds Based on 50% of $4.0B • Extends the Aviation Excise Tax in support of the Airport and Airway Trust Fund through March 31,2010 • Includes authority to make expenditures from the Airport and Airway Trust Fund through March 31, 2010

FAA 2010 AIP Program FY 2010 FAA Appropriation  • “Department of Transportation Appropriations Act of 2010” signed December 16, 2009 • Public Law 111-117 • Appropriation thru September 30, 2010 • Only appropriated $3.515B thru Sept. 30, 2010 of the $4.0B Authorized • $2.0B of the $4.0B or 50% made available thru March 31, 2010

FY 2010 AIP Program FY 2010 Part A October 1, 2009 to December 31, 2009 Did not distribute funds for first quarter of FY 2010 January 1, 2010 to March 31, 2010 Entitlements made available on Feb. 2, 2010 50% Passenger and 57% Cargo Entitlements 68% State Apportionment Discretionary made available on Feb. 10, 2010 Letters of Intent Discretionary Projects Noise funds made available Feb. 22, 2010 MAP funds still not available!

  7. FY 2010 AIP Program • FY 2010 Part A – 3 Options • Carryover to 2011 • Execute a Part A Grant • Do Nothing – Assuming a Risk or “Let it Ride!” • Carryover Deadline had passed • Part A Grants must be Executed by March 17, 2010

FY 2010 AIP Program • Anticipated FY 2010 Part B • Anticipate Remainder of the $3.515B or $1.515B • Anticipate Remainder of Entitlements made available • Remainder 50% Passenger and 43% Cargo Entitlements • Remainder 32% State Apportionment • Anticipate Remainder of Discretionary • If you carried over during Part A, you will not be able to receive discretionary during Part B

  9. FY 2010 AIP Program • FY 2010 Part B – 2 Options • Carryover to 2011 • Execute a Part B Grant • Expect Carryover Deadline mid August • Last year’s deadline was August 20, 2009 • Expect Part B Grants to be Executed by mid to late September • Last year’s deadline was September 24, 2009

Jobs Bill - House of Representatives • House Version H.R. 2847 • “The Jobs for Main Street Act of 2010” • Passed on December 16, 2009 • Contains $37.3 B in Transportation Funding • Contains $500 M for FAA • All for Grants In Aid for Airports • Discretionary distributed using established criteria • Up to 100% federal share (no local match) • Grants executed within 120 days of the Act

  13. Jobs Bill – Senate • Senate Version • Passed on February 24, 2010 • Includes $20B in Transportation Funding • Includes ZERO for FAA!
