  2. The IWG The Infringements Working Group is jointly convened (since 2005) by members of the Financial and Consumer Rights Council (FCRC) and the Federation of Community Legal Centres (FCLC) with the participation of Solicitors from Victoria Legal Aid (VLA)

  3. The Position Paper There are two main objectives of this Position Paper: A. To make key recommendations for systemic reform of the infringements system so it operates in a fairer way for all stakeholders (Part 3); and B. To highlight & address specific issues & adverse impacts of the current infringements system experienced by our clients (Parts 4 & 5).

  4. Simple & Accessible • One central agency • One corresponding number • Training for all court staff • Registrars with special circumstances expertise

  5. Efficient • All reviews by one central agency • All outstanding infringements dealt with at once

  6. Equitable, Proportionate & Just • Proportionate fines especially for Health Care Card Holders • All circumstances to be taken into account • Withdrawal due to special circumstances • A fairer outcome in the special circumstances list • Fair outcomes for children • No imprisonment

  7. Early Identification & Exit • Early exit for special circumstances • Issuing officers to warn not fine • Deal with infringements on receipt

  8. Problem Solving • Early assistance for people with special circumstances • Deal with fines by non monetary means • Make it easier for victims of family violence to nominate drivers

  9. Consistent, Transparent & Informal • Centralised guidelines & criteria for establishing special circumstances • Court should be last resort
